1. TO PARTICIPATE: Listen carefully to WHKY Radio & WHKY-TV between April 1, 2009 and August 8, 2009 ("Contest Period') for instructions on where and how to register to win. 2. GIVEAWAYS: Five finalists will be selected from all qualified entries received at the registration points on Monday, August 3, 2009 and asked to be at L.P. Frans Stadium on Saturday, August 8, 2009. A reverse draw will be held in between innings of the Hickory Crawdads game that night to determine the grand prize winner.
3. CONTEST PRIZE: Prize to be given away to grand prize winner selected Saturday, August 8, 2009 from five finalists as noted above. Finalists may receive consolation prizes at the descretion of the sponsors. Finalists must be present at L.P. Frans Stadium Saturday, August 8, 2009 for each grand prize drawing.
4. ELIGIBILITY: Contest open only to legal residents of the United States residing in the state of North Carolina who are 21 years of age or older as of April 1, 2009. Employees of WHKY Radio & WHKY-TV, the Hickory Crawdads, Hickory Hop, Hickory Travel and Tours and other sponors ("Sponsors"), newspapers, TV stations, CATV Systems, other radio stations and any other Media, and all of their, subsidiaries, divisions, affiliates, distributors, suppliers and advertising, promotional or judging agencies (collectively, "Sponsor and Promotion Parties") and immediate family members of such employees and persons living in the same household as such employees are not eligible to win. Limit one prize per name, address and/or household. Can only win one time.
5. GENERAL: No substitution of prize is offered and non-cash prizes may not be redeemed for cash value, except as determined by Sponsor and Promotion Parties in its sole discretion. Void wherever prohibited or restricted by law. Prize winners will be solely responsible for paying all applicable federal, state and local taxes on prizes; if applicable, winner will receive an IRS Form 1099 for the retail value of the prize. No groups, clubs or organizations may reproduce or distribute any portion of these Official Rules to its members. All entrants, as a condition of entry, agree to be bound by these Official Rules and the decisions of the Stations management, which shall be final and binding. Listeners may qualify only once, unless otherwise specified. Multiple entries by the same person or by a person in the same household will be discarded and be deemed by the station management as a cause for disqualification.
6. WINNER NOTIFICATION: Potential winner will be notified by WHKY Radio and will have (2) business days to respond to the station to accept the prize. If the winner does not respond within (2) business days of notification, the winner will forfeit the prize and another winner will be selected. The Station will make every attempt to contact the Prize Winner, randomly selected, by phone to notify them of their prize. If the winner cannot be contacted in a timely manner (to be determined by WHKY Radio management) another Prizewinner will be randomly selected. Duplicated prizes will not be awarded. Winner must present photo ID, and a valid drivers license. The office is open 9:00am to 5:00pm Monday through Friday, and closed on major holidays. The WHKY Radio studio is located at 526 Main Avenue SE Hickory, NC 28602.
7. RELEASE OF LIABILITY: All qualifiers, by agreeing to participate in the contest promotion, and the Prize Winner and their traveling companions, by acceptance of the Prize, agrees to release Sponsor and Promotion Parties from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses to persons and property which may be sustained in connection with the receipt, ownership or use of the prize or while preparing for, participating in, and/or traveling to and/or from any prize-related activity or any typographical or other error in these Official Rules or the announcement or offering of any prize. Sponsor and Promotion Parties assume no responsibility or liability for any technical malfunction, failure, error, or omission with regard to any equipment, communication lines or systems utilized in the operation of the Contest. Sponsor and Promotion Parties make no representations or warranties of any kind concerning the appearance, performance or safety of any prize awarded. Winner shall bear all risk of loss or damage to prize after delivery. WHKY Radio & WHKY-TV reserves the right to the use winner's name, voice, picture or other likeness without compensation for promotional purposes in all media as determined by Sponsor and Promotion Parties, except where prohibited by law. Each winner must sign a sponsor release form prior to redemption of any prize. WHKY Radio & WHKY-TV reserves the right to make changes in the rules of the contest, which will become effective upon announcement by WHKY Radio & WHKY-TV. Failure to comply with WHKY Radio & WHKY-TV contest rules may result in a contestant's disqualification.
