You are right, it's about copyright. Any right I haven't given up, I haven't given up, right? So it's still mine.


If you don't know what copyright is about, follow the link below and find out. It's very educational. This page is written by Rebeca Delgado-Martinez Valette, Esq., a licensed attorney who presumably knows what she is talking about (whereas I am merely concerned about my rights).







The long version


  1. It is important that you understand the difference between my library files and the source code for the quizzes. You can do almost anything with the individual quizzes: copy them, rename them, modify them.

    The library files are mine, and I reserve all rights to them that I haven't given up here in this document. By default you will store them in a different directory than the one where your individual quizzes end up. I do not give you permission to modify them. And that shouldn't be necessary! (If you feel very strongly that some feature is missing, if you have some good ideas for improvement, contact me on mgriebel@hotmail.com , let's see what I can do about it).

    Why I won't let you modify my library files: Your modifications would be attributed to me, and I wouldn't know anything about it. You could put some funny stuff inside them and say I did that. Next thing, the police knocks on my door. I don't want that.

    You are also not allowed to sell my library files, or give them away for free. If somebody wants my files, let them copy them from my site. You can make backups, of course.

    Any idiot can read these files, they are just plain text. So I am relying on you to act appropriately. Don't sell them, don't give them away, don't copy my work.

  2. As to the source code for the quizzes, you can do almost anything with the individual quizzes: copy, rename, modify them, twist them around and read them in backwards -- as long as it's for your own very private use.

    You may use my quiz-maker to create and use any number of quizzes on your own personal (one user) computer (or on your computer network, as long as there is only one user at the same time). You can allow others to view and use your work (your quizzes) on the same computer.

    I have not given you permission to create quizzes for distribution, not even for free.

    So, you and your buddy can download my system and each create lots of quizzes for yourselves. You can let him/her run your quizzes on your computer, and vice versa. You cannot copy the quizzes between your computers. That is not private use of my system. It's annoying, isn't it?

  3. But then, if you really have something worth showing to others, why not build a web-site? If you want to use my system to create quizzes that are accessible from other computers via the World Wide Web, you can do that, this is shareware. Then you must send me US$40 (or the equivalent amount).

    And that is extremely cheap!

    You and your buddy may create a site together, the licensing fee is per site, not per person, but someone must be the primary contact person. You must send the money to... Well, contact me on mgriebel@hotmail.com , and I will tell you how to pay.

  4. In my wisdom I have determined that private use of my system shall be free, and web-based quizzes shall be comparatively cheap -- provided that they are generally accessible, and you are not making any money on them. You should contact me if you are planning to create a quiz of any other kind:

  5. I don't want you to use my system for commercial purposes...unless, of course, I can get a share. Specifically, you cannot bundle my system with anything that you are selling.

    However, if you want to sell an entire web-site, or give it away for free, or turn it over to somebody else, it's the same as if somebody 1) obtained your data, (that's no part of me) 2) created a new site, and 3) licensed my system -- which means there would be a fee involved. That's it, you may sell your data for what it's worth, and you may sell a site with my system on it. The new owner will have to pay me the normal fee for licensing my system, which is reasonable, since I will have to make updates, new contact person etc.

    If you make a lot of money on selling a site with my system on it, and you think that my system is part of your site's gigantic rise in popularity, you might consider me in your will, or your memoires, or pay me whatever ($400?).

  6. I know I am repeating myself, I will even tell you one more time:

    Your quizzes must be publically accessible, or accessible to one person at a time. I will not forgive you for selling a system for money, with the additional requirement that the end user "go to this fellow's homepage and download some files..." Booh, phew, phui!

  7. All your public quizzes must carry my logo even if you don't like it, and a link to my site. You must also maintain the flash card-feature, that is, all public quizzes must allow the user to print out flash cards. The flash cards must contain my URL.

    If you don't want my logo on your site, you have to pay. Let's discuss it. Hey, I'm cheap!

  8. Tell me about a public site that you have created with my system, and I will (probably) link to it.

  9. There are a few additional requirements (and advice). You will find it in the downloaded files. If you find something in the downloaded files that is not in concordance with the present text, the truth is to be found here on this page.
