	The following question on Kaffara in Umrah was kindly answered by 
Shaykh Mustafa Jaffer.

QUESTION:

According to my understanding, the Kaffara is due for males in EHRAM if they
take shade from sun or rain.  This means that if you perform UMRAH at night,
there is no Kaffara.  IS that correct according to Aga Seestani.  Last year was
the first year in my ten years of experience of UMRAH, that it poured down with
rain at night.  Does that mean that Kaffara is due even if it rains at night.

Some people say that Kaffara is also due for males whether they travel at night
or day. 

Could you please clarify this matter urgently.

ANSWER:

Ayatullah Seestani, in Manasik-ul-Hajj, says:

Shade is understood as taking shelter from Sun; as a precautionary measure
shelter from rain is also included;but wind, heat and cold are different;
apparantely a person wearing ehraam can seek shelter from it. Thus a Muhrim
(person wearing Ihraam) can travel in a closed car during night time - as
long as it does not rain (a precautionary measure) even if the car is
protecting him or her from wind.

Incidentally, Ayatullah Gholpayaghani (May Allah have mercy on his soul),
was also of the same opinion.
