Salamun Alaykum,

The following question was kindly answered by Mulla Asghar

----------------------------------------------------------------------------

Question:

Please reply according to the fatwa of Ayatullah Khui and Ayatullah Sistani.

Most good quality restaurants including (unfortunately) some restaurants
that claim to serve halal food also serve alcoholic beverages in the same
premises and within the same section, served together (but not necessarily
mixed within the food) with the food as well. For example, a common Pizza
chain named Pizza Hut also serves alcoholic beverages with the Pizza upon
request, within their premises. Knowing that all but a few non-Muslim
restaurants serve food in such a manner (with alcoholic drinks to other
patrons nearby), is it permissible for us to selectively eat 'halal' foods
within such places?

----------------------------------------------------------------------------

Answer:

According to both Ayatullah Seestani and Ayatulla Khui, eating and drinking
in gatherings where alcohol is served is haram (forbidden).

However, Agha Seestani says that attending such places (not for eating and
drinking) is allowed if
it is done to forbid others from the evil (i.e. for for doing Nahy `anil
munkar)." (Al-Mustahdisaat minal Masaail al-shar`ee'ah)

Wasalaam,

Asgharali M M Jaffer
