When it says the husband cannot take another wife, does that mean both in permanent marriage and in mutah, or just in permanent marriage? Answer: The condition can be fixed in both type of marriages. Question: Can the condition be put in the marriage contract (that he doesn't take another wife during the marriage) without her giving up her mahr or is giving up her mahr a necessary requirement for that condition to be in the contract? Answer: If both parties are agreed at the outset, then she can stipulate the condition that if he takes another wife during the marriage she will have the right to divorce. She does not have to give up her mahr in this case. This will have to be agreed upon at the time of the marriage. May Allah guide us all. Amin Liyakatali
