In 2001, an 8-year-old Arkansas boy was suspended from school for pointing a breaded chicken finger at a teacher and saying "pow, pow, pow." According to the school, the chicken finger violated the school's "no tolerance" policy against weapons at school.
A Belle, West Birginia junior high student was suspended from school for giving a non-prescription cough drop to another classmate. School policy requires a note from a parent to use any non-prescription medication.
In March, 1998, student activists at U.Mass., Amherst, Massachusetts, seized and occupied one floor of the school's Administration Building for a week demanding racial quotas. Provost Patricia Crosson excused their actions, arguing that "[E]ducation is about freedom of expression and the balance between civil disobedience and the enforcement of laws ..."
Beverley Grammar School in Yorkshire, England, disciplined an 11 year old for "racist humor" after he greeted an Australian fellow-student with the phrase "G'Day sport!" The school code prohibits "racial mimicry" by students or faculty.
In August, 1991, a University of Texas professor testified in a disorderly conduct trial that musician Kevin Michael Allen's defecation on stage during a rock concert in Milwaukee, Wisconsin was a Constitutionally protected act of artistic interpretation. Allen was convicted.
The Colorado Springs school district suspended a 6 year old boy 1/2 day for giving another child a lemon drop candy. The child was disciplined under the school's "zero-tolerance" drug policy for "distributing" the candy to another person. Answering public criticism, a school official pointed out that bringing candy to school was as disruptive as bringing a gun.
A 10 year old girl in Thornton, Colorado was disciplined for a violation of the school's "zero tolerance" sexual harassment policy for repeatedly asking a boy at recess if he liked her.
