Article 2 - Executive Branch
Section 1. The powers of the head of state shall be vested in a president of the Virtual Commonwealth of Cyberia. He/she shall hold office during the term of one year and be elected by a majority of the people. The election of the President shall occur on the first Saturday and the first Sunday of October, or a runoff with the top two candidates may be held the week thereafter. The election will be non-partisan on the ballot, but the Presidential candidates may advertise their political preferences at any point until election day.
Section 2. The President must be a citizen of one of the provinces within Cyberia. No person holding the office of President may hold any other elected office for the whole of Cyberia nor for one of its provinces. This person shall also not hold an appointed position with any provincial government.
Section 3. In the case of the absence of the President, the Chief Justice shall serve all Presidential duties or appoint a member of the General Assembly to serve these duties until such time as a new President may be elected (this shall be done within two weeks of presidential incapacitation). In the event of the temporary absence or incapacity of the President, where the President is able, he/she will be able to appoint a President Pro Tempore for a period not exceeding one month. After this time a presidential election will be called.
Section 4. Regardless of when a President is elected in an emergency situation, they must stand election in the prescribed manner on the prescribed day as described in the Constitution.
Section 5. The President shall be the Commander in Chief of the Armed Services of Cyberia. The President shall be charged with the maintenance of the Cyberian website, all of its subpages, admission of new citizens to Cyberia, and the conducting of the census as prescribed in Article I. The President shall also have exclusive control over judicial nominations.
The President shall have the power to veto bills passed by the Assembly. This power shall include the option to veto only specific portions of bills passed by the Assembly. For every veto, however, he shall submit to the National Assembly a message concernng the reasons for his veto, and what changes might be needed to avoid a second veto. This power shall not extend to bills pertaining to impeachment of the President or any civil official or to bills pertaining to the internal processes of the Assembly. The Assembly may override any Presidential veto by a two-thirds majority vote of the entire membership of the Assembly.
The President will formally announce all elections, assent of bills and legislative agendas. The President may consult with the Ministers on all matters of importance to his presidency. The President will be expected to execute his or her duties in a non-partisan manner.
The President shall once a quarter, give to the General Assembly, information on the state of the country, and recommend such initiatives that he/she may deem requisite on improving the state of the country.
The President shall be the Head of State and represent the Commonwealth overseas. All international treaties must be approved by the President as well as a majority of General Assembly (and a majority of the Senate when it becomes operative).
Section 6. The President shall appoint all members of the Cabinet, with such appointments being subject to approval by a two-thirds majority vote of the Assembly. The Cabinet shall consist of the following ministers:
Section 7. The President and all other civil officers of Cyberia shall be removed from office of impeachment for and convictions of treason, bribery, or other high crimes and misdemeanors.
