C.F.C. 98-025 National Security Act

PREAMBLE: The name of this Act shall be the National Security Act of 1998 and its purpose shall be to provide a mechanism, in the form of a National Security Commission of Cyberia, to conduct intelligence, counterintelligence, civil defense and emergency relief activities on behalf of the Government of Cyberia.

Section 1: There shall be established a National Security Commission of Cyberia, which shall consist of three National Security Commissioners appointed by the President, the Minister of Defense and the Minister of the Interior, subject to approval by a majority of the Chamber of Deputies.

Section 2: Duties. The duties of the National Security Commission shall be as follows:
Section 2.1: To conduct intelligence and counterintelligence activities on behalf of the Government of Cyberia.
Section 2.2: To coordinate civil defense activities and measures in the Virtual Commonwealth of Cyberia.
Section 2.3: To coordinate disaster relief and emergency measures in the Virtual Commonwealth of Cyberia.

Section 3: Powers. The powers of the National Security Commission shall be as follows:
Section 3.1: The National Security Commission shall have the power to conduct espionage activities in foreign nations only on the order of the President of Cyberia, with the advice and consent of the Chamber of Deputies and, at such time as such body becomes active, the Senate.
Section 3.2: The National Security Commission shall have the power to conduct counterespionage activities in the Virtual Commonwealth of Cyberia only on the order of the President of Cyberia, with the advice and consent of the Chamber of Deputies and, at such time as such body becomes active, the Senate.
Section 3.3: In the event of the President of Cyberia declaring a national or regional emergency, the National Security Commission shall have the power to organize and coordinate civil defense and/or disaster relief efforts and measures for the duration of the emergency.

Section 4: Restrictions. The powers of the National Security Commission shall be restricted as follows:
Section 4.1: The National Security Commission shall not, in the pursuance of any of its duties, engage in political assassinations or any other form of terrorist activity or any activity designed to politically destabilize any sovereign nation, unless the nation in question is formally at war with the Virtual Commonwealth of Cyberia. The gathering of intelligence from classified foreign sources shall not be construed as an activity designed to politically destabilize a sovereign nation for the purposes of this Act.
Section 4.2: In the performance of any and all of its duties where Cyberian citizens are involved, the National Security Commission shall strictly observe any and all Constitutional protections enjoyed by said Cyberian citizens.
Section 4.3: All the Commissioners are subject to removal by either the President or the Minister who appoints them and also to impeachment by the Chamber of Deputies as provided for in the Constitution.

Section 5: Organization. The organization of the National Security Commission shall be as follows:
Section 5.1: The Commissioner appointed by the President shall be the High Commissioner of the National Security Commission and shall preside over the proceedings of the Commission. The High Commissioner also shall have the power to overrule or modify the acts of either of the two lower Commissioners.
Section 5.2: The Commissioner appointed by the Minister of Defense shall be the Head of the Bureau of Intelligence and Counterintelligence and shall be charged with conducting intelligence and counterintelligence activities as provided for by this Act.
Section 5.3: The Commissioner appointed by the Minister of the Interior shall be the Head of the Bureau of Civil Defense and Emergency Management and shall be charged with conducting civil defense and emergency relief activities as provided for by this Act.

Section 6: Funding. The National Security Commission shall be funded equally as parts of the budget of the Ministries of Defense and the Interior and such funding shall be included by the President in his/her annual budget request.

Section 7: Severability. In the event that any portion of this Act is found by the Courts to be unconstitutional, such portion shall be severable from any portions of the Act not included or dependent upon the portion found unconstitutional, all of which shall retain full force of law. 1
