Purpose of Compact

The party states recognize that each state is responsible for the management of its nonfederal low-level radioactive wastes. They also recognize that the Congress, by enacting the Low-Level Radioactive Waste Policy Act, P.L. 96-573, has authorized and encouraged states to enter into compacts for the efficient management of wastes. It is the policy of the party states to cooperate in the protection of the health, safety, and welfare of their citizens and the environment, and to provide for and encourage the economical management of low-level radioactive wastes. It is the purpose of this compact to provide the framework for such a cooperative effort; to promote the health, safety, and welfare of the citizens and the environment of the region; to limit the number of facitilies needed to effectively and efficiently manage low-level radioactive waste and to encourage the reduction of the generation thereof; and to distribute the costs, benefits, and obligations among the party states. Authority to Restrict Exportation

The Low-Level Radioactive Waste Policy Act of 1980 provided that states that entered compacts would have the authority to restrict the use of a regional disposal site to waste generated within the compact region. The LLRWP Amendments Act of 1985 provides, in pertinent part:

Any authority in a compact to restrict the use of the regional disposal facilities under the compact to disposal of low-level radioactive waste generated within the compact region shall not take effect before each of the following occurs: (1) January 1, 1986; and (2) the Congress by law consents to the compact. [Emphasis supplied] 42 USC 2021d(c)

There is no specific Congressional authorization for compacts to restrict the exportation of waste from a compact region.
