We can put a little real life in this, since you bring it it. Some years
ago some women in New York challenged the state indecency law on 14th
amendment grounds. [The law made it illegal for women but not for men to
go around in public without a shirt on.] The courts found, indeed, that
the law violated the 14th, which provides for equal protection under the
law.
But! The NYC Trasit Authority still retained a law that it was illegal
for women to go topless in the subway. Incidently, the NYC subway is
not considered a particularly safe area for women, or anyone really. A group
of women, for reasons of thier own, decided to challenged the law by
violating it and going to trial. However, the TA police decided ahead
of time not to bust them (pun). So they rode the subway topless.
It was not reported that they were raped because they went out in
public undressed.
