You are right. The NY Courts have held that it is discriminatory for
the police to prosecute women who are topless while not doing the same
for men. As long as the woman is not topless AND doing something lewd
and/or for money, there is no legal basis for her arrest just for being
topless. This is true anywhere throughout the state of NY.
The challenge is that City Officals are basically ignoring the ruling
and challenging any woman who is topfree to put on her top or face
arrest. Whereas, most women do not wish to be arrested, they comply
with the officials. The NY City Mayor even threatened to arrest any
topfreedom behavior during the NYC Gay Pride Parade in which there is
traditional topfreedomness.
