Will of James Smith
November 12, 1833


I James Smith of the County of Beaufort being of a Sound mind and memory have thought proper to make this my last Will and testament beginning as follows. After all my Jest debts are paid I then give to wife MARY Smith One Negro Woman by the name of Sophia then I give to my Daughter DELL HEDGES One Negro woman by the name of Sua & one child y the name of Hariots. Then I give one Negro boy by the name of Tony to my Son DANIEL Smith. Then I give to my son DANIEL Smith the Clifford plantation.

The I give on bed & bed Stead to my Son DANIEL Smith if My Son DANIEL Smith, should die without Heir then all the property that I have given him is to got to my Daughter ELLEN Smith. Then I give unto my Son SAMUEL Smith one Negro boy by the name of Brister. Then I give to my Daughter ELLEN Smith One Negro boy by the name of Isaac & one Negro boy by the name of Harry. After the expiration of five years then Harry is to be hired out & the money is to go to the use of Schooling the child ELLEN Smith. Then I give to my daughter ELLEN Smith One Negro girl by the name of Violet. then I give to my Daughter DELL SMITH HEDGES, one Negro boy by the name of Elec. then I give one Negro by the name of Louis to my Daughter ELLEN Smith, Then I give One Negro woman by the name of Jane to my wife MARY Smith. Then I give to my son CHARLES Smith Ten dollars. Then I give to my daughter LITTER LATHAM ten dollars if my son SAMUEL Smith will burn both Of tramlines & assist to hull the tar down to Drawings Landing in four months then I give him a Negro boy by the name of Jacob if My Son SAMUEL Smith refuses to burn Off my tramlines then I give the before named boy Jacob to my Daughter ELLEN Smith.Then I give One Gun to my son DANIEL Smith, Then I give One musket to my son SAMUEL Smith. Then I give to my wife MARY Smith my horse bridle and Saddle. Then I give to my wife MARY Smith all my household and kitchen furniture & I also give the plantation whereon I now live & two hundred acres of land Joining the plantation during her widowhood or lifetime after her death or marriage. Of my wife MARY Smith then the furniture plantation & lands death or marriage. Of my wife MARY Smith then the furniture plantation & lands. I give to my daughter ELI (Ellen ?) Smith. Then I give one heifer to my son DANIEL Smith. The balance Of my stock of Cattle I give to my wife MARY Smith, then all my hogs to my wife MARY Smith. Then I Give all the plantation Utensils to my wife MARY Smith. Then I Give to my son DANIEL Smith One Stock Of  bees & the balance Of the bees. I give to my MARY Smith. Then I give all my crop to my wife MARY Smith & my Executor should see any Of the property That I have left to my daughter ELLEN (Ellen ?) Smith likely to be worsted by Any person I give my executor power to use any property any way he thinks but for the interest of the child I leave J. B. Archibell. As an executor to this my last will & testament. I have hereunto Set my hand and Seal this my last Will and testament November 12th 1833.
