William Altom 1834 Land Purchase


A deed from John and William Keneday to William Altom for 16 acres land Registered February 4th, 1835. This Indenture made and entered this 4th day of August, one thousand eight hundred and thirty four(1834) between John and William Keneday of the one part and William Altom of the other part, all of the county of Lawrence & State of Tennessee (?) that the said John and William Keneday hath bargained and sold unto the said Wm. Altom a certain tract of two parcels of land lying and being on the waters of Little Buffalo and Brush Creek, containing sixteen acres (?) and bounded as follows: Viz the first tract commences on the southwest corner of a twenty acre tract of land entered in the name of Ely. M. Keneday on an elm and runs north 50 poles to a stake in Little Buffalo. Thence east 39 poles to a stake in Asa Butlers west boundary line thence south 50 poles with said Butlers thence to a stake in said line thence west 39 poles to the beginning, containing twelve acres and thirty poles in Range 6 and Section 2. The other a small tract of land lying on the Northeast corner of a 30 acre tract of land entered in the name of John Keneday and runs from thence east 32 poles to a dogwood and scyamore thence south 25 degrees west 26 poles to a hornbeam thence north 15 poles to the beginning in the same range & section aforesaid for and in consideration of the sum of one hundred and fifty dollars in hand paid to said Wm. Keneday the receipt is hereby acknowledged and a further sum of one dollar in hand paid to the aforesaid John Keneday the receipt is further acknowledged we have therefore sold the aforesaid two tracts of land with all the appearances thereto belonging to have and to hold unto the aforesaid Wm Altom his heirs and assigns we bind ourselves our heirs and unto the said Wm. Allom his heirs and assigns free from the claim of ourselves and free from the claims or claims of all and every other person whomsoever in witness thereof we bind ourselves unto the said Altom in a further sum of one thousand dollars witness our hand and seal this 4th August, 1834 herefore written.

Buchanon, clerk of the county court of said county Netherland Tait and Daniel Kutch subscribing witnesses to the foregoing deed who being sworn depose and say they are acquainted with William Keneday and John Keneday the makers of the same and that they executed the same for the purposes therein contained upon the day it bears date. Witness my hand of office the 6th, October, 1834

EX PARTE PETITION OF ESTHER ALTOM

December Term 1846

This cause coming on this day to be heard before the Honorable Levy H. Cohal, Chancelor and upon the petition of Petitioners & is appearing to the court that Wm. Altum died in Lawrence County same time in the month of September, 1846 intestate leaving his widow Esther Altum, A. J. Altum, Eli Altum, John Morris & his wife Jane(late Altum), Maxwell Keeling & his wife Esther(late Altum), Wm. Shipman & his wife Elizabeth(late Altum), Phebe Altum, David C. Altum, and John M. Altum, the last three nemed being minors his only heirs in law & of his estate. That at the time of his death said deceased was the owner & in possession of the lands specified in the indebtedness filed with said petition, and of a negro man named Martin a slave for life, aged about eighteen years, besides a once viable amount of other personal property. It also appearing to said court that said deceased was very late in debt. That said Joseph Mercer was appointed at the November term of this county court of said county and was a lawyer certified according to law as administrator of said estate & that since that time sold All the personal property, said negro accepted half the debts of deceased and it also appearing to the court the said widow is entitled to her Dower in said estate & the other (illegible)


A POWER OF ATTORNEY FROM A. J. ALTOM

TO JOHN A. HAGANS, LAWYER IN 1850

The State of Arkansas Ouachita County Know all men by these presents that I, Andrew J. Altom of the county and state aforesaid has nominated constituted and appointed and do by these presents nominate constitute and appoint John A. Hagins of the State of Tennessee in Lawrence County my true and lawful attorney in fact, to grant bargain sell and coonvey all of my rights, title and interest to a certain tract of land lying and being in said county of Lawrence on Chiefs Creek and Little Buffalo and known as the tract of land once owned by William Altum deceased. Also I give and grant unto my said attorney full power and authority to sell and convey all of my rights, title, interest, and claims unto a certain negro man slave for life by the name of Martin in in General to do and transact any business for me and in my name whereever I may have any legal interest in said county of Lawrence or in the State of Tennessee giving unto my said attorney my whole power and strength to sign seal and (?)deeds in my name and (?) and giving him full power to sign in my name or to be signed for me & in my name if it should ever become necessary and in general to do and perform any acts for me and in my name in the State of Tennessee, ratifying and confirming all my said attorney acts and deeds, and the same shall be as legal and as valid in law as if I were personally there myself and were to of done the same. Altom whose genuine signature is to the above and foregoing Power of Attorney, an instrument of writing to me personally make known and acknowledge that he did sign and seal said power of attorney on this day the same bears date and for all the purposes and considerations therein contained and (?) and desired the same to be certified which is done. In testimony whreof I have hereunto set my hand and affixed the seal of my office at my office in the city of Camden this 11th day of July A.D. 1850
