This Indenture Made the Thirty First Day of December in the Year of our Lord One thousand Seven Hundred & Ninety Six. Between Jacob Lantz of Caernarvon Township Lancaster County and the State of Pennsylvania, Yeoman of the one part and Owen Thomas of the same place Yeoman of the other part. Witness that the said Jacob Lantz for and in Consideration of the Sum of one Shilling lawful money of Pennsylvania to him in hand well and truly paid by the said Owen Thomas at and before delivery hereof the Receipt whereof is hereby acknowledged. Hath granted, bargained, sold, and Confirmed and by their presence, (and pursuant to a former Contract Between John Lantz & Joseph Yoder) Doth Grant bargain sell and Confirm unto the said Owen Thomas and to his Heirs & Assigns a full free Constant and absolute priviledge and liberty to make Keep and uphold a Certain Dam on the Land of said Jacob Lantz at the place where formerly and usually a Dam stood and now is made as high and in such a form as the said Owen Thomas his Heirs or Assigns may deem requisited for the purpose to Dam and Confine one half of the water which flows thro' said Lantzes land and arises above said Dam and for the use of said Owen Thomas his Heirs and Assigns with the Liberty to Convey said water thro' the Land of said Jacob Lantz by a sufficient drain or Course until it Runs upon the Land now in possession of the said Owen Thomas with free and absolute Priviledge of going to and from the said Dam and drain or water Course for Conveying and Repairing the same as often and at any time when the said Owen Thomas his Heirs or Assigns or any other Person in his or their name thinks proper. And also a free priviledge and Liberty that the said Owen Thomas his Heirs or Assigns at any time or times hereafter, may lead and Convey the water of the highest Spring to the Creek in the upper meadow of said Jacob Lantz, near the water race in Trunks or pipes to the house where the said Owen Thomas now lives The best and straightest Course or where the water of said Spring usually drains down thro' the meadow or Land of said Jacob Lantz. To the said Owen Thomas his Heirs or Assigns to have full Liberty to cut a Ditch for said Trunks or pipes to be placed in and to Burry the same such in the Ground, and to level the Ground where the said Trunks are laid, (which must be done by him his Heirs or Assigns if ever the said Trunks be laid or water of the spring Conveyed) And to have full priviledge of replacing (?) and repairing, where said Trunks or pipes are laid in over and for the purpose of mending and repairing the same if occasion requires But with doing as little Damage as possible To have and to hold said half part of said water and Priviledge of Conveying said Spring in manner aforesaid, unto the said Owen Thomas and to his Heirs & Assigns To the only proper use benefit and Behalf of him the said Owen Thomas his Heirs & Assigns forever. And the said Jacob Lantz for himself his Heirs Executors and Administrators Doth Covent promise grant and agree to and with the said Owen Thomas his Heirs & Assigns by these presents, That he the said Owen Thomas his Heirs and Assigns Shall and Lawfully may from time to time and at all times hereafter peaceably and quickly have hold Occupy Possess and Enjoy the one half part of the water aforesaid as also the water of said Spring in manner aforesaid with free (? access. egress, and regress ?) unto said Dam and drain and priviledge hereby Granted Agreeable to the true Intent and meaning of their presences, without unlawful lot(?) trouble, hinderance, or Molestation of him the said Jacob Lantz his Heirs or Possessor or Possessors of his Land & Plantation or of any other Person or Persons whatsoever by or with his their or either of their act, means, Consent, Deivity(?) or Procurement. In Witness whereof the said Jacob Lantz to these presents has herewith set his Name & Seal on the day and year first above written.
