Will of PETER BROUGHTON

(written 31 May 1768 - proved 19 May 1769)

In the Name of God, Amen, I Peter Broughton of the Parish of St. John Berkley County, being of sound and disposing mind (Blessed be God) but being mindful of the Fraility and Uncertainty of Human Life do make this my last Will and Testament in form and manner following. First I commit my Soul into the hands of Almighty God, in hopes of a Joyfull Resurrection to Eternal Life through the Merits and Mediation of Lord Jesus Christ and my Body to the Earth to be decently buried according to the discretion of my Executors hereafter Named, and to such Worldly goods as it hath pleased God to Blefs me with I give and devise in form and manner following. Imprimis my Will is that all my Just debts be first paid Secondly that my Estate be kept together for three years and the profits arising Yearly therefrom first paying the Charges of the Estate be applied by my Executors in paying of such bonds as I stand security too for my Brother Andrew Broughton, and then my Estate by my Executors to be divided and disposed of as follows.

Item I give and bequeath to my Dear and Loving Sister Anne Sanders the following Slaves (to wit) Ceasar, Phillis his Wife, Tom, Bristol, Summerset, Duckey, and Quash with the Ifsue and increase of the several Slaves to her and the Heirs of her Body for ever.

Item I give and bequeath to my Dear and Loving Nephew William Sanders my Watch and One yung Mare to be pickt from my Stock of Horses,

Item I give and bequeath to my Dear and Loving Nephew Thomas Sanders my English Mare,

Item I give and bequeath to my ear and Loving Nephew Lawrence Sanders two young Mares to be pickt from my Stock of Horses,

Item I give and bequeath to my Dear and Loving Cousin Mary Broughton, daughter of my Cousin Alexander Broughton, my White Riding Horse and one Neat Side Saddle to be bought by my
Executors out of my Estate and the Horse and Saddle to be given her at my death,

Item I give and bequeath to my Dear and Loving Brother Andrew Broughton and my Dear and Loving  Nephew Thomas Broughton Son of my Brother Thomas Broughton the Residue of my
Personal Estate to be equally divided between them to them and their heirs for ever,  my Will is that all my Lands to be sold by my Executors and the purchase Money to be equally divided between my Dear and Loving Brother Andrew Broughton my Dear and Loving Sister Anne Sanders and my Dear and Loving Nephew Thomas Broughton Son of my Brother Thomas Broughton or the heirs of their Body as shall then be living, that is to say the Children of the deceasest to receive such part as their Father of Mother, would have done in case they had been living and no more, ut in case my Nephew Thomas Broughton Son of my Brother Thomas Broughton shall not arrive to age of Twenty one years then I give and bequeath that part of my Estate left to him to be equally difided beween my Dear and Loving Brother Andrew Broughton and my Dear and Loving Sister Anne Sanders and the Heirs of their Body for ever, my Will is that my Executors shall not take any Commifsions from any Estates I am Executor for, but in case those Estates or the Heir or Heirs of any of them should make any demand or Charge against my Estate then and in that case my Executors to have full power to Charge the full commifsions on such Estates, and I do hereby Constitute and appoint my Dear and Loving Brother Andrew Broughton and William Sanders Executors of this my last Will Testament Revoking all former last Wills, In Witnefs whereof I have hereunto set my Hand and Seal this Thirty First day of May 1768.

Whereas in my last Will hereunto Annexed I here Bequeathed to my Cousin Mary Broughton my White Riding Horse, which Horse has since Strayed and is lost, I hereby direct my Executors (in case my said White Horse is not found within Six Months to purchase a neat Horse at the Price of Sixty or Seventy pounds Price which I bequeath the said Mary Broughton instead of the aforesaid Horse, I further declare it is my Will to give to my Brother Andrew Broughton my Black Riding Horse and this I declare and publish as a Codieil to my last Will.
