Will of THOMAS BROUGHTON

IN THE NAME OF GOD AMEN I Thomas Broughton of the Parish of St. Johns Berkely County being of Sound & Dispofing Mind (Blefsed be God) But being mindful of the Frailty & uncertainty of human Life do make this my Last Will & Testament in form & manner following. FIRST I committ my Soul into the Hands of almighty God in hopes of a Joyfull resurrectin to Eternal Life through the Merits & Mediation of our Lord Jesus Christ & my Body to the Earth to be decently buried according to the discrefsion of my Executors hereafter Named. & as to Such Worldly Goods as it hath Pleased God to blefs me with I give & devise in Form and Manner Following

IMPRIMIS My Will is that all my Just Debts be first paid

ITEM I give & bequeath to my dear & Loving Wife Sarah Broughton (in case I have no Children) so Long as she Shall remain Sole & unmarried, the Income & Neat Proffitts of my Whole Estate both real & Personall after paying the Plantation Charges & the Legacy to my Mother hereafter mentioned to her own Proper use and behoof But in case I Leave any Children then I give & bequeath the said Neat Profitts of my Estate towards the Maintainance of my Wife & Children untill my Children arive at the age of Twenty one Years of be married or my Wife be Married whichever Shall first happen

ITEM I give & bequeath to My Dear & Loving Wife Sarah Broughton the following Slaves (to wit) Malborough Carolina, Charles, July, Jack, Venter Cyrus, Hercules, Phillis, Balinda (Lucy George & Peggy her Children) with the Ifsue & Increase of the female Slaves to her & her heirs forever

ITEM I give & bequeath to my Dear & Loving Wife Sarah Broughton all my Household goods Plate & Linen, with the Chair & two Horses & one Half of my Stock of Sheep Cattle & Hogs with their Increase to her & her Heirs for ever

ITEM I give & bequeath to my said Executors all those my two Tracts of Pine Land Containing one Thousand acres or thereabouts Commonly Known by the Name of Soboy to be sold by them & the Purchase Money to be paid to my Wife Sarah Sarah Broughton [sic] for her own Proper use & behoof forever

ITEM I give & Bequeath to my dear & Loving Mother Hannah Broughton the Sum of Ten pounds (Lawful Mony of Great Brittain P Annum during the Term of her Natural Life to Be paid
out of my Esta. Annually

ITEM I give & bequeath the Residue of my Estate both Real & Personall to Such Child or Children as may be Laiving [sic] at the time of my Death or may be born within Nine Months after my Decease to be Equally Devided amongst them by my Executors, Except My Dwelling House at Seaton & the Land belonging thereto which they Shall not take Pofsefsion of till after the Decease of my Wife or after she shall be married again which ever shall first happen. But in case I Leave no Children & none be born within nine Months after my Decease or they Should all Die before they arrive at the age of Twenty one years or be married Then I give & Bequeath that part of my Estate Left to my Children in the following manner.

ITEM I give & bequeath to my Dear & Loving Brother Andrew Broughton (after the Death or Marriage of my Wife Sarah Broughton) all that my Plantation Containing fifteen Hundred acres of Land more or Lefs Commonly Known by the Name of Seaton To him & his Heirs forever. But in Case he should die without Ifsue then I Give & bequeath the said Plantation Called Seaton (after his Death) to my Eldest Brother then Living & to his heirs forever

ITEM I give & bequeath to my Dear & Loving Wife Sarah Broughton all such part or parcell of Land Containing five Hundred acres more of Lefs that fhall fall to my Share out of Land Containing four thousand one hundred & fifty Acres Granted my Late Father Mr. Andrew Broughton Lying & being in Granville County & Joyning Lands of Robt. Johnson Esqr. & the Late Mr. Paul Jenys to her & her Heirs for ever But if she should die before my said Children then the above Land be Sold by my Executors & the Purchase money to be equally Devided between such of my Brother & Sisters or the Heirs of their Body as Shall be then Living, that is to Say the Children of the Deceast to receive Such part as their fathers or Mothers would have done in case they had been Living & no more

ITEM I give & bequeath to my Dear & Loving Brother Andrew Broughton one Negroe Man Named Joe to him & his heirs forever.

ITEM I give & bequeath to my dear & Loving Nephew Andrew Broughton
(Son of my Brother Andrew Broughton) one Negroe man Named Mulberry to him & his Heirs
for ever

ITEM I give & bequeath to My Dear & Loving Brother Peter Broughton & Robert Broughton the residue of my Estate to be Equally Divided between them To them & their Heirs
forever ---

AND I do hereby Constitute & appoint My Dear & Loving Wife Sarah Broughton Executrix & my Dear Brother Andrew Broughton & Peter Broughton Executors to this my Last Will & Testament revoking all former Last Wills IN WITNEFS Whereof I have hereunto Set my hand & Seal this Twenty Second day of May 1752 ---

WHEREAS I have (Since the Signing & publishing the within Instrument of Writing as my Last
Will & Testament) I have purchased a Plantation or Tract of Land of Andrew Quelch Containing
by estimation Two Hundred & Eighty acres of land or thereabouts lying & being in the Parish of
St. Johns in Berkley County & Scituate on the Eastermost side of the Western Branch of the T of
Cooper River & between Mepkin Bluff & the Plantation Commonly Known by the name of the
Strawberry. One Moiety or half part of which said tract of Land I am by Agreement to Convey &
make over to my Brother Peter Broughton for & in Consideration of Three Hundred & fifty pounds Current money which he has already paid to me in hand & Whereas the Titles for the Said
Land are not Yet made & fetover [setover] to him I DOE HEREBY give and bequeath to my Said Brother Peter Broughton one full Moiety of half part of the said Tract of two hundred & Eighty Acres of Land or thereabouts be the same more of lefs to be laid off & admeasured from Mepkin Bluff downwards together with one full Moiety or half part of all the overplus Land contained in the above Tract or anyways appertaining or belonging thereto, if any Such be found when the same shall be surveyed & Settled To him & his heirs for ever, And I do hereby declare this to be a Codicil to my said last Will and testament and as such I do sign seal publish it this first day of March in the year of our Lord one Thousand Seven hundred & Sixty.
