with $1,000, which he gave to Franklin College, in Georgia. Being tooproud
under the circumstances to accept help, although he was not rich, he was
capable of the greatest intellectual efforts and the highest attainmentsin
science, philosophy, and politics. His quick repartee, keen sarcasm, close, and
extensive observation, made him one of the most agreeable talkers of hisday.
He removed to Jasper County, GA, where he found a large field for fun and
satire, better lands to cultivate, and improved society for his children. He
was very industrious and economical, and acquired a large estate. He moved
again, this time to Mt. Meigs, bought the Pollard place near Montgomery,AL.
His humor was constantly hunting material for enjoyment, he was buildinga
log cabin in his yard, when his wife came out and objected to the mannerin
which he was doing it. He listened patiently for awhile, and finally
reasoned with her, but she still insisted on her way, so he just steppedout of
his trousers and threw them down to her, telling her to put them on, andwear
them. If Tam O'Shanter had been passing by when Jack's dumpy person wasperched
and breechless, and had heard his spiel to his wife, how he would haveshouted,
'well said, short shirt.' Mr. Marks was devoted to his wife and parental
objection only served to increase his love." (See Gilmer's Georgians.)

p. 230: Yazoo Land Fraud: "In 1795 the Georgia legislature had solda huge
area in what is now Alabama and Mississippi to four landcompanies for a
tiny fraction of its value, something less than two cents andacre. When
it came out that many of the legislators had been corrupted, thenext
legislature canceled the grants, but not before the originalgrantees
had unloaded large tracts on various third parties. Theseinnocents
turned to the federal government for relief when the grants werecan-
celed. Jefferson favored a bill giving 5 million acres to theseinter-
ests...The compromise bill was defeated."
(footnote) The controversy then entered the courts, and in 1810Chief
Justice Marshall held in FLETCHER V. PECK that in resinding thegrant
Georgia had committed an unconstitutional breach of contract. Before
Marshall's ruling, however, the federal grant was finallyapproved by
Congress. Had it not been, FLETCHER V. PECK would have providedthe
"victims" of the Yazoo frauds with an area considerably largerthan the
state of Mississippi!"5 DAR, Historical Collections of the Joseph Habersham Chapter DAR, VolIII
