This Indenture made this second day of January in the year of our Lord one thousand eight hundred between William Guthrie of the one part and Robert Smiley of the other part, both of the County of Greene and State of Tennessee, Witnesseth that the said William Guthrie for and in consideration of the sum of five hundred dollars to him in hand paid receipt whereof is hereby acknowledged hath and by these presents doth grant bargain and sell alienate en??? And confirm to the said Robert Smiley his heirs and assigns forever a certain tract or parcel of Land containing one hundred and five acres lying and being in the County of Greene on the south side of Lick Creek beginning at the mouth of a small creek on a box elder running east two hundred and forty poles to a black oak, thence north seventy poles to a stake thence west two hundred and forty poles to a stake thence south seventy poles to the beginning. Containing one hundred and five acres it being part of a tract of land obtained by George Halmark from the state of North Carolina the patent bearing date the 20th day of September in the year of our Lord 1787 and in the 12th year of our independence with all the Improvements whatever appertaining or in anywise belonging unto the said one hundred and five acres of land, so as to make to the said Robert Smiley his heirs or assigns forever a true and perfect estate of Inheritance in fee simple. To all to whom these presents shall come greetings:
Know ye that we for and in consideration of the sum of fifty shillings for every hundred acres hereby granted paid into our Treasury by Adam Guthrie have given and granted and by these presents do give and grant unto the said Adam Guthrie a tract of land containing one hundred and twenty three acres lying and being in our County of Greene. Beginning at a post oak on the north bank of French Broad River on a corner of James Hubbards land, then north three hundred and twenty five poles with said Hubbards line to a stake standing thereon then due east until it strikes the river a persimon then down the meanders to the beginning. As by the plat hereunto annamed doth appear together with all woods, waters, mines, minerals, hereditaments and appurtinances to the said land belonging or appertaining to hold the said Adam Guthrie his heirs and assigns forever yielding and paying to us such sums of money yearly or otherwise as out general assembly from time to time may direct provided always that the said Adam Guthrie shall cause this grant to be registered in the registers office of the said County of Greene within the time limited by law otherwise the same shall be void and of no effect. In testimony whereof we have caused these our sellers to be made patent and our great seal to be hereunto affixed witness Richard Dobbs Spaight Esquire our governor Captain General and commander in Chief. At Newbern the 12th day of January in the 17th year of our Independence and in the year of our Lord one thousand seven hundred and ninety three.

This indenture made and entered into this 11th day of November 1840 between John Guthrie of the one part and John Henderson of the other part both of the county of Green and State of Tennessee Witnesseth that the said John Guthry for and in consideration of the sum of one dollar to him in hand paid by John Henderson hath granted bargained and also his right title interest claim and demand to a certain entry made by Peter Brown and John Guthrie for thirty acres on Nolochucky river No. 1299 Beginning on a stake on the north sife of Nolochucky river opposite the lower end of said John Henderson's Island corner to a tract of land granted to David Taylor by the State of North Carolina on the north side of Nolochucky river nearly opposite the lower point of the island and in a line of a tract of land granted to Stokely Donaldson by our own State or North Carolina with said line up the river one hundred and fifty poles to a stake thence south to the south side of the river a line of the lands of John Henderson thence down the river with said line one hundred and fifty poles thence to the beginning to have and to hold to the said John Henderson his heirs and assigns forever against the lawfull title claim or demand of all and every person or persons whatsoever claiming title thereunto in through or by me will warrant and forever defend in Witness whereof I have hereunto set my hand and seal the date and year above written.

Be it remembered that at the February Term 1837 of the Chancery Court at Greeneville Tennessee, the following decree was pronounced by said court in the suit of Noah Cate Guardian of the minor heirs of Samuel J. Lee deceased vs. John Rader and James G. Guthrie - to wit

Friday 17th February 1837

Noah Cate Guardian of the Minor Heirs of Samuel J. Lee deceased vs. John Rader & James G. Guthrie

This cause came on for hearing the 16th day of February 1837 before the Hon. Thomas L. Williams Chancellor upon the Bill, answers, replication & proofs and the Chancellor being of the opinion that the complainants are entitled to be vested with the legal title to the tract of land discribed in the deed of trust as containing ninety acres situate in the counties of Greene, Jefferson and Hawkins, bounded as follows viz. Beginning at a dogwood on a corner of said Readers line, Bulls Gap, thence with said line north thirty one degrees E seventy five poles to a dogwood thence north to a cherry tree the distance not known, but on William Keels line thence east ninety two poles to a stake thence south one hundred and fifty poles to a stake thence east Eighty seven poles to a stake, south sixty five degrees west one hundred and twenty five poles to a stake thence seventy five poles to the beginning.
It is therefore ordered adjudged and decreed by the court that the title legal and equitable to the above described tract of land be and the same hereby is divested out of the said James G. Guthrie and John Reader Sr. and also out of all others persons and the same is hereby vested in the said James Lee and Caroline Lee the minor heirs at law of said Samuel J. Lee deceased their heirs and assignes in fee simple and it is further ordered that said James and Caroline Lee on the application of their guardian may have a writ of possession requiring the Sheriff of Greene County to put them in the immediate possession of said premises and it being suggested that the said John Rader has been in the possession of the said premises or a part thereof - and also in receipt of the rents and profits thereof - since the 31st July 1827 the date of the Trustees Sale up to this time or a portion of said time at least. And the Chancellor being of opinion that defendant Reader is liable to account to complainants for the reasonable rent of said premises during the time which he may have occupied and possessed the same and that his is also liable to account for any rents and profits which he may have received from others holding, using or occupying the same under him. It is further ordered that it be referred to the master to take an account and state - 1st what would be a reasonable allowance per annum for the use and occupation of said premises from the 31st July 1827 to the time of taking said account - 2nd What portion of the time during said period have said premises been used and occupied by the respondent in doing which the master shall distinquish between the time respondent used and occupied the same as ostensible owner - and the time when he may have held the same or any portion thereof under any other person during a claim thereto under complainants - 3rd The master shall also enquire whether desponant Reader has ever received any rents profits or issues in any way from any other person or persons under the License or authority of said defendant and that the clerk and master also enquire what part of the said ninety acre tract the said John Reader did occupy and how long and it is furthered ordered by the court that each party that is the guardian and defendant Reader in there cause pay their own costs.

Mr. J.C. VANCE and wife, Mary A. VANCE, for and in consideration of the Sum of five dollars to us paid have this day bargained and sold and do hereby transfer and convey unto Geo. T. PINKSTON of Mohawk, Tenn all the right, title and interest which we have and hold in and to a S all? piece of land situated in 6th Civil Dist. of Greene Co. Tenn. one mile west of Mohawk and bounded and described as follows:-
Beginning at the north corner of the said G.T. PINKSTONS lot. Thence N. 1 1/20 E. one pole to a stake. Thence S. 72 1/20 W. to a point intersecting the line of said PINKSTONS lot. Thence with PINKSTONS live N. 73 3/40 E to the beginning. Being a lot one rod wide at N.E. end and converging to a sharp point and containing one tenth of an acre more or less. We are lawfully seized of said land, have a good and perfect right to convey the same and the same is unencumbered and we will forever warrant and defend the title to said land to the said G.T. PINKSTON his heirs or assignees against the legal claims of all persons whosoever.

We further covenant and bind ourselves, our heirs and representatives, to warrant and defend the title to said property to the said James MYERS , or his successor in trust, and his assigns, forever, against the lawful claims of all persons.

But this conveyance is made in trust for the following uses and trusts, and for no other purpose, to wit:
We are justly indebted to A. A. GUTHRIE in the principal sum of Fifteen Hundred Dollars, evidenced by our three promissory notes of even date herewith, for $500.00 each, and due and payable four, five, and six years after date, respectively, with interest from date at the rate of 6 per cent per annum, and providing for 10 percent attorneys fees if sued on or placed in the hands of an attorney for collection.
 
 

Now, if we shall pay the sum s aforesaid when due, according to the terms of said note s , then this instrument is to be of no further force or effect. But if we fail to pay the sum s of money when due as aforesaid, or any part of said sum s , according to the terms above expressed, then, upon such default, this conveyance remains in full force and effect, and the said Trustee, or his successor in trust, is hereby authorized and empowered, upon giving 30 days' notice by 5 printed posters, posted publication in newspaper being waived at 5 public places in Greene County, Tennessee, to sell said property at the Courthouse door in said County, to the highest bidder, for cash, and free from the equity of redemption, homestead, dower, and all other exemptions of every kind, which are hereby expressly waived, and the said Trustee, or his successor in trust, is authorized to make a deed to the purchaser. The creditor may bid at any sale under this conveyance. We agree that the Trustee may, at any time after default in payment of principal or interest as each falls due respectively, enter and take possession of said property and shall only account for net rents received by him.
And we agree to keep all the buildings on said property insured in some reliable fire insurance company or companies for the sum of $ 100. 00 until the sum herein secured is fully paid, and to have the loss made payable on the policy to said Trustee for the benefit of the owners and holders of the debt herein secured. We agree to keep the improvements on the said property in good repair and preservation and to pay all taxes and assessments, and to pay them when due; and in case we fail to do either; then said Trustee, or the creditor herein secured, may do either, and charge and treat the amount so expended as a part of the debt herein secured.
In case of sale under this Deed of Trust, the proceeds will be applied by the Trustee:
First_To pay all the costs and charges of executing this trust, including attorney's fees and the expense of any litigation which may arise on account of the execution and enforcement of this trust.
Second_To pay said debt, or any balance thereof then remaining unpaid.
Third_The residue to be paid to James MYERS
or order. And in case of the death, absence, inability, or refusal to act of the said Trustee, at any time when action under the foregoing powers and trusts may be required, the owner of the debt herein secured is hereby authorized to name and appoint a successor to execute this trust, and the title herein conveyed to
James MYERS
shall be vested in said successor.
In the event of a sale of said property under and by virtue of this trust, we
and all persons holding under us shall be and become the tenants at will of the purchaser of the same, from and after the execution and delivery of a deed to such purchaser, said tenancy to be determined at the option of said purchaser upon five days' written notice.

The land is bounded on the North by land of said WAGNER and McQUEEN: On the South by other lands of the Grantors and the said Georgetown Pike road: On the East by land of said SOLOMON and the center of Candy's Creek and on the West by land of WAGNER and McQUEEN and the said MRS. M. J. WRINKLE and being that part of the real estate purchased by the grantors of F. M. HUSKEY and wife by deed or record in the Register's office in Deed Book "36", pages 408-9 to which reference is made.
Reference is made to said Map of the Subdivision of said SOLOMON farm as a surveyedby the County Surveyor, J. B. McKINZIE.

TO HAVE AND TO HOLD the same to the said MARY LOUIS DYER, her heirs and assigns forever in fee simple. We covenant that we are lawfully seized and possessed of said Real Estate, have full power and authority to sell and convey the same, that the title is clear, free and unincumbered, except for the taxes for the year 1922, which the Grantor pays, and we will forever warrant and defend the title thereto, to the said MARY LOUIS DYER, herheirs and assigns against all lawful claims.
And EFFIE SOLOMON, wife of the said E. R. SOLOMON, for value received join in the above deed and convey to the said MARY LOUIS DYER, all right and claim I now or may hereafter have to dower or homestead in or to the above described premises.

But this deed is made for the following uses and trusts and for no other purposes that is to say we are indebted to HUNTSMAN and MYERS by note of hand of this date and due at twelve months in the sum of Three Hundred Eight and 86/100 dollars and am desirous to secure and make certain the payment if the same. Now if we should pay the said debt at the time aforesaid then this deed to be void But if we should not, then the said John BARLOW as Trustee after giving thirty days notice in writing at the Court House door of said County and at the election ground of the 6th District of said County of Greene and at three other public places in the neighborhood way? expose the said lands to public sale and sell it to the highest bidder for cash and in bar of the equity of redemption and appropriate the proceeds first to the pay much of the necessary expenses and costs secondly to the satisfaction of said debt of $308.86 dollars and interest and thirdly to pay the balance if any then be to us.

Bounded on the North by land of BOONE: On the South by the Georgetown Pike road: On the East by FRED L. POTTS land and land of MRS. WAGNER and on the West by the Georgetown Pike road and a road leading North from the Georgetown Pike road; and being all the land lying East of the Georgetown Pike conveyed to us by ALLISON BROWN and wife, by deed of record in the said Register's office in deed Book "30" pages 30 and 31, to which reference is made, except about one half acre the grantors heretofore sold to MRS. McCOWN out of the South side of said 100 acres, and reference is here made to all title papers for description of all lands herein referred to.

TO HAVE AND TO HOLD the same to the said T. L. ROGERS, his heirs and assigns forever in fee simple, we covenant that we are lawfully seized and possessed of said Real Estate, have full power and lawful authority to sell and convey the same, that the title is clear, free and unincumbered, and we will forever warrant and defend the same against all lawful claims.
And MAUDE BENTON, wife of the said FRED E. BENTON, for valuse [values] received join in the above Deed and convey to the said T. L. ROGERS, his heirs and assigns all right and claim I now or may hereafter have to dower or homestead in or to the above described premises.
