IN THE NAME OF GOD Amen. I Cornelius Sale of the County of Essex being of sound sence and memory make this my last Will and Testament hereby revoking all other Wills by me made. First I give & bequeath unto my Grandson, William Sale, half my tract of Land where on my Son, Wm. lived wch: tract I purchased of Augustine Smith to my said Grandson & his heirs forever & the other half of the same Tract of Land I give the whole use of to my Daughter in Law, Hannah Blackbourne, during her natural Life and after decease I give the said Land to my aforesaid Grandson, William Sale, and his heirs for ever, the said Hannah to have the Plantation into her part.
Item. I give to my said Grandson Five pounds to be paid at my Wife's death;
Item. I give and bequeath unto my Son, Anthony Sale, Five pounds to be paid at my Wife's death;
Item. I give and bequeath unto my Son, John Sale, all the Lands I bought of Majr. Robert Brooke with all that part of the tract whereon I now live wch: lyeth on the West side of the Main Road that leads from Garnetts Mill to the Range, to my said Son, John Sale and his heirs forever;
Item. I give to my said Son, John Sale, one Negro boy named George to him and his heirs forever.
Item. I give and bequeath unto my Son, Cornelius Sale, all the Lands that I bought of Francis Pagit and Daniel Tucker, and all my other Lands not before bequeathed after my Wife's decease to him and his heirs forever; but if my sd. Son, Cornelius Sale, should depart this life without lawfull issue, then I give and bequeath all the said Last mentioned Lands to my Son, Thomas Sale, and his heirs forever; But if he die without issue lawfully begotten then I give and bequeath the said Lands to my Son, John Sale, and his heirs for ever, after the decease of my Wife;
Item. I give to my Son, Cornelius Sale, five pounds to be paid at my Wife's death;
Item. It is my will that my Son, Thomas Sale, have the use of my dwelling Plantation with the Lands that I bought of Tucker for ten years after my Wife's death if he should not be provided with other Lands to live on before the expiration of the said ten years;
Item. I give and bequeath unto my said Son, John Sale, three Negroes named Jack, Kate and Amey, with their future increase to him and his heirs forever, with Five pounds after my Wife's death;
Item. I give and bequeath unto my Son, Thomas Sale, two Negroes named Jenny and George with their future increase to him and his heirs forever;
Item. I give and bequeath unto my Daughter, Hannah Hannah Sorrill on Negro woman named Doll and her future increase to her & her heirs forever; and Five pounds current money to be paid at my Wife's death;
Item. I give and bequeath unto my Daughter, Elizabeth Farmer, one Negro boy named Ralph, together with Five pounds current money to be paid at my Wife's death to her and her heirs forever;
Item. I give to my Grand Daughter, Mary Fisher, Five pounds currt. money to be paid when she come of age or marry;
Item. To prevent all disputes about the property of any Negroes which I have allready given and is at this time in the possession of any of my Children, all such I give to the present possessors of them and their heirs forever;
Item. I give to my beloved Wife during her naturall Life the plantation whereon I now life wth: the use of all my Negroes not allready delivered to my Children and the use of all my personall Estate;
Item. It is my will that after the Legacies in my Will given are paid that then all the rest & residue of my personall Estate after my Wife's death be divided between my two Sons, John Sale and Thomas Sale, but my will is that it be devided so that my Son, Thomas, have Ten pounds more than the one halfe thereof;
Lastly. I do appoint my Son, John Sale, and my Son, Thomas Sale, my Exrs. of this my last Will and Testament. In Witness whereof I have here unto set my hand and Seal this third day of Aprill 1745
At a Court held for Essex County at Tappa: on the 17th day of March Anno Dom: 1746 This Last Will and Testament of Cornelius Sale deced., being presented in Court by John Sale and Thomas Sale, the Executors therein named who made oath thereto, And being also further proved by the oath of all the witnesses thereto and the heir at Law appeared and having no objections to make to the proof of the said Will, which was ordered to be recorded and is truly recorded
