In the name of God amen. I Dolphin Lindsey being advanced in years and of feeble health but of sound disposing mind and memory feel that is necefsary that I should make distribution of such of my property as has still remained to me from the devastation of the late war. Do make ordain declare and publish this my last will and testament hereby revoking all wills by me at anytime heretofore made.

1st I will my soul to God who gave it and desire that my body shall be decent buried by my family and friends.

2nd I will and bequeath to my beloved wife Milly Lindsey all of my estate both real and personal of every kind such as ready money notes accounts stock Horses Household and Kitchen furniture plantation tools provision and produce together any other species of property of which I may die Siezed and pofsefsed to occupy use and enjoy the same during her natural life and after her death to be equally divided between Sarah Brown wife of Robert Brown Nancy Lindsey wife of Joseph Lindsey Georgia Lindsey wife of John G. Lindsey to vest in said Sarah Brown Nancy Lindsey Georgia Lindsey Share and Share alike as their Sole and Seperate property free from the debts contracts control or liabilities of their present or any future husband and I hereby constitute and appoint my son John G. Lindsey Trustee for said Sarah Brown Nancy Lindsey and Georgia Lindsey to receive manage and control such part of my estate as may fall to the share of each in such manner as will be for their best interest and advantage under such restrictions and limitations as prescribed by law for trustees and after the death of Said Sarah Brown Nancy Lindsey and Georgia Lindsey it is my will and desire that their respective portions shall be equally divided among their respective children.

3rd I will and bequeath that my Executer hereinafter named do at once pay to Malinda W. Whaley wife of Wilkins D. Whaley the Sum of five dollars and to the children of Dolphin S. Lindsey five dollars. These small legacies are given because heretofore I have made to each of them ample advancements.

4th I hereby constitute and appoint my son John G Lindsey Executer of this my last will and testament.

Signed Sealed declared published and proclaimed by Dolphin Lindsey as his last Will and testament in the presence of the undersigned witnefses this the twenty seventh day of August in the year of our Lord one thousand eight hundred and seventy.

The above and foregoing two pages has this day been declared published proclaimed and signed by Dolphin Lindsey as his last Will and testament in our presence as witnefses and the said testator signed the same in the presence of each of us and each of us have signed as witnesses at the instance of said testator and in his presence and in the presence of each other Augt 27 1870.
