WILL OF THOMAS HILL


YORK COUNTY, VIRGINIA ORDER & WILL BOOK 14 (p.86); 1710


In the name of God Amen. the twenty Eight day of August One thousand Seven hundred & ten I Thomas Hill of Efsex Lodge in the Parish of York hampton & County of York being Sick & weak in body but of Perfect Sence & memory thanks be given unto God therefore calling unto mind the mortallity of my body & knowing that it is appointed for all men Once to dye, do make & Ordain this my last will & Testament: that is to Say Pincipally & first of all I give & recommend my Soul unto the hands of God that gave it & for my body I commend it to the Earth to be buried in a Christian like & Decent manner at the discretion of my Execx. hereafter named - nothing doubting but at the generall Resurection I Shall receive the Same again by the mighty power of God & touching Such worldly Estate whwerewith it hath pleased almighty God to blefs me in this life I give devise & dispose of the Same in this manner & form following - Imprimis my will & desire is that after my funerall Expenses all my just debts be fully Satisfyed & paid. Item I give unto my son John Hill all my dividend or tract of Land comonly Called by the name of Efsex lodge by Estimacon Nine hundred & thirty acres with all the houses & appurtenances thereunto belonging to him & to the heirs of his body lawfully begotten for ever freely to be pofsefsed & Enjoyed/when he Shall accomplish the age of One & twenty years and if it please God that my said Son John Hill Shall dye before the age aforesd. or without ifsue then my will & desire is that my land Called Efsex Lodge Shall be equally divided amongst my fower daughters Mary Hill Eliza. Hill Ann Hill and Lucy Hill - Item I give unto my same Son John Hill my Silver headed Caine - Item as for my personall Estate household goods & moveables of what kind soever I lend unto my loving wife Mary Hill to have the use during her Widdowhood and if in Case She Should alter her Condition by marryage then my will is that all my personall Estate Shall be Equally divided amongst my wife & five Children to each an equall Share & I do Constitute make & ordaine my loveing wife Mary Hill my only & Sole Execx. of this my last will & Testament & I do hereby utterly disallow Revoke & disannull all & Every other former wills Legacies bequests & Execrs. by me in any will before this time named willed & bequethed Ratefying & Confirming this & no other to be my last will & Testament In Witnefs whereof I have hereunto Set my hand & Seal the day & years above written;

This will & Testamt. of Tho. Hill was presented in Court by Mary Hill Relict & Exectx. therein named who made Oath to it & the Same being proved by the Oaths of Robt. Crofs & Nathl. Crofs is admitted to Record & Probate thereof granted the sd. Exectx. accordingly -

Test Phi. Lightfoot C Cur

Whereas in the Lifetime of Thomas Hill of the Parish of York Hampton & County of York the said Thomas in Consideracon of ten Shillings to him in hand paid by his daughter Eliza. Hill did bargain & Sell one Cow Calf wch. is now four years old marked with a Crop a Slit & underheal in the left Ear & a Crop & underheal in the Right Ear & there being given by Hester Sefsions in her Widdowhood to Lucy Hill also the daughter of the sd. Thomas one two years old heifer marked on the right with a flower deluce & a Crop & Slitt & underheal on the left ear for Confirmacon of the aforesaid bargain & Gift to the aforesd. Eliza. & Lucy. Know all men by these presents that I Mary Hill Relict & Execx. of the aforesd. Thomas do hereby Ratify & Confirm the aforesd. Gift & Sale to my Daughters Eliza. & Lucy as they Severally before are mentioned. In Wittnefs whereof I have hereunto sett my hand & Seal this 21st day of May 1711.
