In the Name of God Amen. The Seventeenth Day of December In the Year of our Lord One Thousand Seven Hundred & Seventy two I Walter Newman of Heidelberg Township in the County of Lancaster being weak of body but of perfect mind and Memory thanks be to Almighty God and Calling to mind the Uncertainty of this Mortal life and knowing that it is appointed for all men once to dye do make this my Last Will and in the Manner following first and Principally I give and Recommend my Soul into the hands of God my Saviour and My body to the Earth to be buried in a Christian like manner at the discretion of my Executors not doubting but at the General Resurrection I Shall receive the Same again by the Mighty Power of God and as Touching Such worldly Estate wherewith it hath Pleased God to blefs me with I give devise and dispose of in the Manner and form following First my will is that all my Just Debts and funeral Expences be discharged and paid out of my Personal Estate Item I give and bequeath unto my dearly beloved wife Elizabeth all my Real Estate and Personal during her Natural life Excepting the Wagon and Harnefs and Gears Plow and Harrow, them I give unto my Two Sons Vizt. Henry and David Item I give and bequeathe unto my Daughter in Law the Fifty Acres of Land Mefsuage and Tenament that is Now in her Actual Pofsefsion be the same more or lefs during her Natural life if She remains a Widow but If Shee marry then that Tract of land I give to my Grandson her Suposed marryage and if Shee doth Remain a Widow then my will is that my Grandson Walter get it at my Daughter in Law decease and that that Tenement Plantation or Tract of Fifty Acres of Land be the Same more or lefs to be to him his heirs & and afsigns forever he Paying the Quitrents and paying the further Sum One Hundred and Fifty Pounds Lawfull Money in three Years After his Mother's decease to his Brothers and Sisters to be Equally divided between them and if any of them Should dye having no heirs then that Shear is to be divided Equally between them or their Survivors and that Walter my Grandson is to heave the Priveledge of using the water on monday Night every week & no longer but is to Let it Run through his Plantation without any hindrance or molestation Item I give and bequeathe unto my Son John Newman his heirs and Afsigns forever after my wifes deceas the Plantation Improvement or Tract of Land that is now in his Actual Pofsefsion he paying the Quitrent and paying the further Sum of Ten Pounds Lawfull Money unto my two Sons Vizt. Son Henry the Sum of Five Pounds and my Son David the like Sum of five Pounds in four Years after my wifes deceas and that he the said John Newman is not to Stop the water but to let it Run the Course that it now goes without any molestation or hindrance from him or his heirs forever Item I give and bequeath unto my Sons Henry and David Newman their heirs and Afsigns forever after my wifes deceas the Plantation Mefsuage or Tenement on which I at present dwell Containing About One Hundred and Twenty Eight Acres more or lefs Together with the Rents profits or Incomes of the said Town that I now live in to be all Equally Divided between them or their heirs paying the Quitrent and paying the further Sum of Four Hundred Pounds in Four Years. After my wifes deceas unto my daughters & Grand Children Vizt. To my Daughter Hannah The Sum of One Hundred Pounds Lawfull Money or to her Survivors (to my Daughter Mary The Sum of one Hundred Pounds or to her Survivors) and Allso the Sum of One Hundred Pounds like Lawfull Money to my Daughter Elizabeth or to her Survivors) and the Sum of One Hundred Pounds like Money to be paid unto my Son George his children Vizt. Simon Cathrine Barbara and Susanah which is to be Equally divided between them and if any one of them dyes without heirs then that Shear is Also to be Equally divided between his brother and Sisters Item tis my will Also that my Sons Henry and David Newman Shall heave & keep my Horfes Wagon Plow Harrow Together with the Gears & Implements thereunto belonging to and with the Plantation bequeathed unto them and that my Sons Henry and David Newman or their heirs Shall give or Cause to be given yearly Thirty Buchels of Clean wheat & Twenty of Rye with one fat Hog and Ten Pounds of Clean Hackled flax unto my beloved wife during her natural life out or from the said Plantation that I heave bequeathed unto them as before mentioned Item I give and bequeath unto my Son Peter Newman the Sum of Twenty Shillings Lawfull Money he being my Eldest Son to be paid out of my personal Esteat after my wifes deceas Item I give and bequeath unto my Son Andrew Newman the Sum of five Shillings out of my personal Estate after my wifes deceas Item I Also will is that all the surplus of my personal Esteat Excepting the Affore mentioned Legacies that is to be paid to my Sons Henry David Peter and Andrew all the surplus to my beloved wife at her own disposal it is Also my will that If any of my Children hapen to dye leaving no heirs then his or her Shear to be Equally divided between all my Children and be it further ______ed that as I have Bequeathed Sundry Land Improvements & Tenements unto my Sons after the deceas of my beloved wife upon their Paying their Respective Legacies it is there further my will that my Sons Vizt. Henry Newman David & John Newman may not nor Shall not Sell nor dispose to any Body any of the within forementioned Lands or Improvements whatsoever untill the Affore mentioned Legacies be all discharged and paid I do also appoint and Nominate my Son Peter Newman & Morris Tuple my Sole Executors and I do hereby disallow Revoke and disannall all other former Testaments and wills Legacies or Executors by me in ways before this time Named willed and bequeathed Ratifying and Conforming this and no other to be my last Will and Testament In Witnefs whereof I have hereunto Set my hand and Seal the day Year Above written Signed -

Signed Sealed Published Pronounced and declared by the said Walter Newman as his last Will and Testament in the presence of us the Subscribers N.B. what is interlined is done before the Executing hereof, George Hudson, henry Seller.

Note And Whereas I have thought it Nesicary to make an Arrangement to my will that is Within mentioned Since the first Sealing and Delivery thereof to wit I being weak, but of perfect mind & memory and whereas I heave bequeathed a Tract of Land unto my Son John Newman his heirs and afsigns he paying the Sum of ten Pounds and I heave likewise bequeathed to my Sons Henry and David the Old Plantation that I live on to their heirs & afsigns they paying the Sum Sum of Four Hundred Pounds it is therefore my will that if my Son John doth not discharge and pay his said Legacie within the Term of Four Years after his Mothers disceas as within mentioned then he Shall Sell it to one of his brothers if the will give him as good a prise as a Stranger that is to Say his Brothers or any one of them is to heave the first offer if he will Sell it and if my Sons David and Henry do not discharge their Legacies within Four Years after their Mothers disceas as within mentioned then they Shall not Sell their Land untill they have offered it for Sale to their said brothers for the price that a Stranger would give or any one of their Said brothers that will give the best price for the Same According to the true Intent and meaning of these presents annexing this addition as part of my Last Will and Testament hereby Ratifying & Confirming the Same in Testimony whereof I heave hereunto Set my hand and Seal this Ninth day of August Anno Domini 1774. Lancaster County fs. On the Thirteenth day of September Anno Domini 1774. Before me the Subscriber Personally Appeared the within Named Peter Lebo & George Hudson the two Subscribing Witnefses to the within Annexed Codicil and on their Corporal Oath did depose and Say that they were present and Saw and heard Walter Newman the Testator within Named Sign Seal Publish Pronounce & declare the within annexed Codicil as and for his Last Will & Codicil & that at the doing thereof he was of Sound & well disposing mind Memory and Understanding to the best of their knowledge Observation and Belief.

Before me the Subscriber Personally Appeared the within Named George Hudson & Henry Seller the two Subscribing Witnefses to the within Annexed Will and on their Corporal Oath did depose and Say that they were present and Saw and heard Walter Newman the Testator within Named Sign Seal Publish Pronounce & declare the within annexed writing as and for his Last Will & Testament & that at the doing thereof he was of Sound & well disposing mind Memory and Understanding to the best of their knowledge Observation and Belief.

Be it remembered that on the Thirteenth day of September Anno Domini 1774 The Last Will and Testament of Walter Newman late of Heidelberg Township in the County of Lancaster Yeoman deceased was proved in due form of Law and Letter. Testamentary were granted to Peter Newman & Moritz Duble, the Executors therein Named they being first duly Qualified well and truly to Administer the Estate of the Testator and to exhibit a true and perfect Inventory thereof into the Registers office at Lancaster on or before the Thirteenth day of October next and to render a true & Just Account of their Administration when thereto Lawfully required Given under the Seal of the said Office.
