Sherman ACKLEY2 was
born on 28 Oct 1830.4 He

1854 in New York City, New York THE UNITED STATES vs. ALBERT S ACKLEY
This defendant was arrested a few weeks since and held to answer for manslaughter
on the high seas in killing one Matthew Nelson, a seaman on board the American
ship Vanguard, which sailed from this port to Liverpool on Friday, Sept. 24,
1853. It appeared in evidence that while the ship was off Staten Island, Nelson
and others of the crew, under the charge of the second mate, went aloft to reef
topsails; that an altercation arose between Nelson and the officer aloft, while
they were aiding the others in the duty of reefing; after they came down Nelson
struck the second mate and knocked him down to the deck. The first mate the
defendant, then interfered, whereupon Nelson drew his knife from the sheath and
said, You, too you son of a ---, if you come another step toward me I'll
show you---. The first mate (Ackley) then drew his pistol and shot Nelson
dead. Ackley was arrested by the captain, put ashore and the ship proceeded
on her voyage; and since that time the wife of Nelson has been unwearied in her
endeavors to bring the case to the notice of the United States authorities, but
after a careful investigation the learned Commissioner dismissed the complaint.
He died on 7 May 1866 in Suffolk , New York.4
