ELECTA ACKLEY vs. HENRY ZUTEPHANT; Forcible Detainer.

Electa Ackley owned a house and lot in the Severance and Folsom allotment at 55 Bridge Street. The property was the west half of lot 14. Adjoining her property on the west was a strip of land with a frontage of 16 feet and a depth of 100 feet which she claimed to have acquired from her sister's estate in l850.
Electa never had title to this strip but claimed it by possession, as her sister had for 8 years before her.
B. S. Welch deposed that be was the owner of the sixteen foot strip and that he held a deed to it. He acquired the land when it was sold for taxes on January 2, 1855.
John Fernald, agent for Electa, rented for $1 a week the west half of her
house on Bridge Street to Henry- Zutephant, a teamster. A Morgan family rented
the east half of the house for 50 cents a week.
Morgan began the erection of a barn on the sixteen foot strip to house Zutephantts team. Welch asserted that he gave Morgan permission to do so. Zutephant at that time thought the strip belonged to the lot but when Welch showed him his deed he decided to purchase the strip. Electa. called on Welch in August 1863 to buy his title to the strip. Welch deposed that she offered him 2 cows as p~vment an an extra $0. Electa claimed that she offered no more than the value on his tax certificate. That same month she found Zutephant erecting a house on the strip. Zutephant claimed that he had purchased the land from Welch for $50 plus taxes for 1862 and 1863. He paid$15 down and agreed to pay the balance in one year. Zutephant moved out of the house at 55 Bridge Street on October 10 and moved into the house be had built. E1ecta on April 9, 1864 served notice on him to leave the premises. She filed suit against Zutephant before Justice of the Peace Wells Porter asking for possession of the property. A jury rendered a verdict in her favor. Zutephant on May 24, 1864 filed a petition in error against Electa in the Court of Common Pleas. A jury returned a verdict in favor of Electa. Zutephant appealed to the District Court, which sustained the decision of the lower court. She was living in 1870 in Cleveland, Cuyahoga , Ohio.720 She appeared in the census 1850, 1860 & 1870 in Ohio. Epaphroditus ACKLEY and Electa BROWN had the following children:
