n spent just enough time with this lawyer to get his child support payment plan worked out. A date was set for a hearing and things seemed to be going preety well at that point, I THOUGHT. The day of the hearing my son arrived at the courthouse expecting
o be treated as an equal. He found out that there was nothing further from the truth. When the time came in the proceeding to dole out time with his child, the judge looked at my son and ask if saturday from 10:00 to 3:00 was good for him? I was setting b
hind him but even at that angle I could see the shock by his body language as he anserwed no. Then the judge said how about tuesdays from 10:00 to 3:00 also? He said ok. As my grand-daughters mother and her parents left the court room they looked over at
y son and myself and laughed. We were broken hearted. Our daughter-grand-daughter had been with us at least half the time for the first three months of her life and now my son was going to be a small-part time parent because he was born a male. Once the
ourts established who the boss was the mother decided we could have her all we wanted. I've been a stay at home grandmother for five years taking care of my grand-daughter while her mother and daddy work. My son called me every day before leaving his job
o see if his daughter was with us because we've never been on any kind of schedule because the mother has wanted me home ready to care for my grand-daughter whenever she chose to bring her. I know that seems hard to believe but that is how my son, myself
nd my husband have lived. During these most precious years we've had with our child and grandchild the problems with her mother have been ongoing. She's called all the shots and my son has let her and so have I for fear of losing the child again. My son h
s been to his lawyer numerous times with reports of mental abuse of his daughter by her mother to no avail. My son's lawyer and other knowlegable people who know how the courts work against fathers have advised him to do nothing. My grand-daughter started
school this fall and around the same time my son found a lovely women he believes is his soul mate, this turn of events has caused the mother to with-hold the child again and we are in agony. My sons lawyer was contacted and he has started the ball rollin
to try to get sole custody or shared time custody. The mother is becoming desperate and I'm frightened what she might make up because she has made up stories many times before if we slip up and fall out of line, thats been another way she has overpowere

Folks, we all have our cross to bear, but the opportunity to change the laws happens once every two years and the time is now! Last Tuesday, I attended a public meeting of the Child Support Guidelines Review Commission in Frankfort. At that meeting, Tom
Mercer, Commission member and General Counsel for the Cabinet for Families and Children said "Joint Custody Stinks." Shortly, calls will be made for Mr. Mercer to publicly apologize to those parents and their attorneys who either stipulate or fight for j
int custody, or resign. His comments were unacceptable and should they have pertained to a topic such as gender, race, religion, sexual orientation, etc. there would be an outcry from statewide newspapers and leaders calling for his immediate ouster over
such blatant disregard. BUT, Mr. Mercer's remarks are to be expected, because, he was not speaking as someone who is concerned with the best interests of a child, but in doing the pragmatic and expedient political activity of a bureaucratic lawyer. Sham
on him!
In his testimony before the Special Task Force on Parenting and Child Custody, Dr. Ed Gross,MD, then President of FORCE had this to say about joint custody:
"Dr. Gross thanked Co-Chair Jordan for giving him the opportunity to speak. He said that the children were the individuals who mattered in child custody disputes. Children should have access to the care and comfort of both parents following divorce. So th
re are two issues. One is children's rights. The other is equality between men and women following divorce. As much as possible, he would like to eliminate the adversarial nature of child custody disputes. As fault based divorce was ended, so fault based
hild custody should end.
He does not favor a fifty-fifty split between the mother and father in custody matters. He does favor a rebuttable presumption in favor of joint custody which permits judges to decide on a case by case basis." ... Dr. Gross then identified the various bil
drafts in his written materials. The first created a rebuttable presumption in favor of joint custody. Three bill drafts dealt with enforcement of visitation"....
As you can see, FORCE has been striving to make a rebuttable presumption of Joint Custody part of KY law, yet there are KY bureaucrats like Tom Mercer who could care less about joint custody or Kentucky's children.

I am a 20 yo female and I was involved in a custody battle about 5 years ago.
Here's my story:
My father is an alcoholic and the whole time I was growing up, he was drunk. My mother, after 14 years of marriage, divorced him because he was so unstable and unreliable. My parents divorced when I was 8 yo and my father moved out. I didn't see him for a
out six months after they divored. I missed my father desperately and wanted more than anything to have a relationship with him. Afterall, he was my father. My father resumed contact with me and got remarried. He still drank and could not hold down a job
or more than 6 months. After about 4 years of marriage to my stepmother, he found another woman and got divorced again. He stopped drinking and I was really proud of him. I started spending more and more time with him and decided he had changed for the be
ter and I wanted to live with him. However, he lived in another county so it would mean living away from my family. I told my father about this matter, and he assured me that I would be able to see my mother and the rest of my family whenever I wanted, so
he got a lawyer and after a few months got custody of me. Everything ran smoothly for about 2 or 3 months. I was so happy to get to live with my father. But, he changed again and began using drugs and would not let me have contact with the family I grew u
with. He held my mail from my friends and wouldn't let me talk on the phone. I told him that things were getting really crazy and I wanted to move back in with my mother. He became abusive and refused to give my mother custody back, even though I begged
him to sign me back over. Finally I got in touch with my mother and she filed for custody. After a lengthy and awful custody battle, she got custody of me. I haven't talked to my father since. I learned later that he was drawing welfare off of me and that
s all he wanted me there for. Even though it has been a long time since all of these things happened, I am still very much traumatized by those events. My father still owes my mother thousands of dollars in child support which she will never get from him.
I think that for every good mother, there are at least 2 father like mine. I think we should let the courts give custody to the more responsible parent when the divorce is made final. Father like mine usually will take any actions to make an extra buck (d
awing welfare on their children). I am very lucky that I had a caring mother who was willing to fight harder than my father did to get me back. For all of you fathers that are serious about getting custody of your children, good luck. Everything will work

ldren ages 11 and 8. I had been employed by the same company since prior to the birth of my children and made good money while my ex-husband had erratic and unreliable employment. I had no criminal history of any kind, never even a traffic ticket. My life
involved going to work and coming home to my family, with few activities outside of home and church. I had the friendship and respect of our small community, including my church in which I had been actively involved. I had impeccable character witnesses,
hile my ex was only able to produce one person, a former employee of mine, on his behalf, and that person could only say things that were equally positive about both of us. Living in a small Southern rural area, I felt certain that circumstances in my fav
r. The court found in favor of my ex, in that joint custody was ordered with him having "primary" custody (lived with him, in the household which had mostly been paid for by myself over the previous 14 years). What I learned is that this type of custody m
ans absolutely nothing; it is completely under the control of the "primary" parent. This included bringing the children late or not at all at the court-designated "visitation." Mine was one overnight during the week, every other weekend and alternating ho
idays. It should also be said that I paid generous child support to my ex faithfully every month. In return for this, he slandered me to my children, calling me names and filling their heads with lies about me to the point where they became suspicious and
distrusting of their mother. When I would protest his violations of our custody agreement (once, he even refused to bring them to me on Mother's Day), he would threaten me. If I didn't seem scared enough, or back off, he threatened other members of my fam
ly. He carried guns in his vehicle at all times. He moved a woman almost young enough to be his daughter into our former home without benefit of marriage and under the noses of our two young children. He lost our home due to repossession and moved the kid
to Indiana and wouldn't tell me where they lived or their phone number. (He did bring them in for visitation most times during this period, however). This whole sorry saga went on for 13 months. I always felt the judge finally became sick of hearing abou
his offenses and awarded me full custody. We seldom heard from this example of a Kentucky father after that. I was awarded child support but have never received a dime from him and am too reluctant to upset our family life over it to try and collect it.
he kids have been back with me for about 18 months now and are just now getting to see their father from time to time. He came to see them 5 or 6 times over the course of the last year, even though I have not tried to deny him access to them. I know this
s from a different perspective, but as a mother, I was in the position of being wrongfully separated from my children. My best advice is to keep a cool head, document all violations, and keep trying. That's what worked for me.

e way that I do. The courts in Pike county don't want to hear about what the children are doing without. If you go out on a Friday night, or Saturday night in Pikeville, especially around the first of the month, you will find 90% of all the single mother
in the county at the local bars, and 90% of all the divorced dads are footing the bill. What's even worse, we can't find an attorney in Pikeville who specializes in much more than disability cases, or compensation cases. HELLO...This county is desperate
for any fathers rights organizations. I am supporting my daughter from a previous relationship . Loving your child and wanting them to grow up emotionally and physically healthy has nothing to do with money. I think every state in the union should have an

ced. Here's some advise to anyone in a situation like mine was...
1.)Be careful who you listen to and who you ignore...sometimes you have to ignore everyone!
2.)Do your homework!!! Hit the library, look at the same statutes the judge is going to look at and do your best to fulfill everyone of them. If you can't, maybe you should reconsider going for full custody...maybe some sort of joint custody would work.
3.)Don't be afraid of a young female judge...they're more open minded than a fifty-something guy.
4.)Never put your interest in front of the kid's, and do not forget to pray...alot!

Download Internet browser---Internet Explorer 3.02
