Note filed on the 7th day of May 1840 for one Hundred and Sixty six Dollars and 25 cents bearing date the 22nd of April 1840 at ten per cent from the date, Summory issued on the 9th day of June 1840. Summory returned exceded on the 27th day of June 1840 by me I Shanblin, the party appearing and it is therefore considered that the plantiff recover Judgement for Eighty Nine Dollars and 75 cts for his debt and for Fourteen Dollars & nine cents for his damages and also for 81 cents for his cost~ Debt $166.25 Credit of $75.50 89.75 Interest 1402 10384

This day came the parties aforesaid by their Attornies and agree to submit this cause to the decision of the Court and the Court doth find for the Appellee Moses Cleaton Eighty six Dollars and twenty five cents for his debt besides his cost
Therefore it is considering by the Court that the said Moses Cleaton the Appellee recover against the said David Ray and R B Harris his securety in the appeal bond the said Debt of Eighty six Dollars and twenty five cents and also his cost and charges by him about his surt in this behalf laid out and expended as well before the Justice of the peace as in this court and the said David Ray and R B Harris be in mercy __ and that he have execution thereof

Now at this day comes the aforesaid parties by their attornys and thereupon comes the following Jurors of a Jury towit Jesse Ross, Elijah Combs, William Mobley, John P Ingram, John Rogers, Albert Madole, Jeptha D Brashears, Joseph Adcock, William Gibbs, and Joseph B Norris, twelve good and lawful men who being duly elected ___ and sworn upon their oath to well and truely try the issue lined herein- And not having time to get through this case the Jury are permitted to seperate until tomorrow Morning 9 oclock

Now at this day comes the Jury sworn and empanneled on yesturday, this day appeared in their seats and do day upon their oaths that we the Jury find the Defendant David Ray not guilty and finds the Defendant Tira Ray quilty and assess the plantiffs damages to One Hundred and fifty dollars
Therefore it is considered by the court that the said plantiff recover of the said defendant the sum of One Hundred and fifty dollars as also costs by him laid out and expended in and about this suit in this behalf and that he have execution thereof

Tyra Ray Defendant Indictment for assault with intent to Kill
Now at this day comes the attorny who prosecutes for and on behalf of the State and the Defendant in his own ___ person and it being demanded of him how he would aquit himself of the charges professed against him in said indictment says he is not guilty in manner and form as charged against him in said indictment and of this he puts himself upon the county and the attorny who prosecutes for and on behalf of the State does the like and thereupon came the following Jury To wit Henry Chance, John W Muir, Stephen Fisher, Simon Ratcliff, John W Wooten, James _ Ellis, J B Thurman, A W Bowles, Miles Richie, William Calhoun, T J Bond and John __itt twelve good and lawful men who after being duly Elected tried and sworn to well and truly try the issues Joined herein and after hearing all the evidence in the Cause __ by consent of parties permitted to seperate until tomorrow morning nine oclock under the usual charge of the Court

Now at this day comes agian the Jury sworn and ________ on yesterday and having heard all the argument of Council in said said cause upon their oaths do say We the Jury find the Defendant not guilty in manner and form as charged in said indictment
Therefor it is considered by the Court that the defendant go home without and thus he recover of the Said State of Missouri his costs by him laid out and expended in and about his defence in this behalf
