In the name of God Amen. I Samuel Brown of the County of Green and State of No. Carolina, being sick and weak in body, but of sound, disposing mind and memory do make and ordain this instrument of writing to be my last will and testament in manner and form following, viz: I recommend my soul to Almighty God, who gave it me. My body to the earth to be buried in a decent manner and as touching my worldly estate which it has been pleased God to bestow on me I leave in the following manner. Item I lend to my beloved wife Elizabeth Brown so long as she may continue to be my widow my land and plantation whereon I now live, my still, all my kitchen furniture, all my farming utansials, my bofat and crockery ware, one Bureau, one trunk, and walnut table, all my siting chairs, one flax wheel and two woolen wheels, also two beds and furniture, also two negroes known by the names of Melba and Centha. Item I lend to my wife Elizabeth Brown during her natural life one negroe named Dicy, one bey horse, my chas and harness, one feather bed and furniture, two cows and calves, six head of sheep, two sows and pigs, all the geese and dung-hill fowls. I also give to my beloved wife Elizabeth Brown a sufficient quantity of corn, pork, etc. to maintain her and her family decently one year. Item I give to my beloved son Abel Brown my land lying on sough side of Nantrenta Swamp containing by estimation one hundred and forty acres more or less, adjoining the land of A. Darden and others to him and his heirs forever. I also give and bequeath to my son Abel Brown two negroes known by the names of Dred and Aaron, also one black horse, bridle and saddle, one no-horn cow and yearling, two heifers, also ten head of sheep, also three sows and pigs and twelve shoats, one feather bed and furniture, and all the household and kitchen furniture which is at his disposal at home, also two cuting axes and two hoes, one plow hoe, stock & traces, and his part of the corn that growd on his plantation to him and his heirs forever. Item I give to my beloved son John Brown my land lying in Pitt County containing three hundred and seventy acres on the beaver dam swamp adjoining the lands of Simon Keal and others, also two negroes named Axum and Charlotta, one bed and furniture, also all the property of whatever kind which he has now in his possession in Pitt County to him and his heirs forever. Item I give and bequeath unto my beloved son Samuel Brown at the death of my wife or of her marrying my land and plantation whereon I now live lying on Nantrenta and Appletree Seamp, also after the death or marriage of my wife I give and bequeath unto my son Samuel Brown one negro man Milby, also one barrel still, also all my farming tools, the kitchen furniture and bofat and crockery to him and his heirs forever. Item i give and bequeah unot my said Samuel Brown one tract of land on the long branch adjoining J. Holmes, one negro girl named Mary, one bridle and saddle, one bed and furniture, one cow and calf, two sows and pigs, four head of sheep, one Gum table, to him and his heirs forever. Item I give and bequeath unto my beloved daughter Peggy Brown two negroes named Edah and Campen, one feather bed and furniture, two head of cattle, three sheep, one flax wheel to her and her heirs forever. item I give and bequeath unto my beloved daughter Charlotte Forrest two negroes named Isham and Sophy, one bed and furniture, one heffer, four head of sheep to her and her heirs forever. Item I give and bequeath unto my beloved daughter Clary Brown two negroes named Hanner and March one bed and furniture two head of cattle, three head of sheep, one blew chest and at her mother's death or marriage one wallnut table to her and her heirs forever. Item after all my just debts are paid I leave to be divided equally amongst all my children shear and shear alike, all the property lent to my wife which have not been given away, also all the property which is not divided in this will to them and their heirs forever, and lastly I nominate, constitute and appoint my two sons Abel and John Brown my executors to this my last will and Testament revoking all others heretofore made by me. W. R. Haynes & wife Sarah R. Haynes & others vs. Franklin Brown & others petition to divide slaves. Be it remembered that on this the 4th day of December 1854 came on this cause to be heard and was heard by the worshipful County Court of Haywood County upon the bill and petition of petitioners and now __ as to the defendants and it appearing to the satisfaction of the court that the notice required by the court has been duly made in the Brownsville Journal for four successive weeks directing and ordering the appearance of defendants under the order aforesaid. And it appearing to the satisfaction of the court that the application of petitioners is reasonable and ought to be granted, it is threfore ordered adjudged and bound by the court that __ Curry, Hugh M. Clark, Alexander Gray, Anthony and John B. Campbell or any three of them be appointed commissioners who shall divide and set apart to each of the heirs towit: W. R. Haynes & wife who represent Peggy Tyson who was Peggy Brown, Abel Brown representatives, Charlotte Forrest, Samuel Brown representatives, J. Holloway & Clara & representatives, John Brown represented by F. W. Tyus and others, the slaves to divide into six parts as follows: Nan, Cinthia, Jonas, Bettus, Carry, Jack, Elly, Malinda, Rosel, Caroline, Willis, Bettus, John Jun, Louisa, Margaret, harriet and the __ for the last eighteen months be by said commissioners also taken under their notice and divide into six equal parts with said slaves so as to make share and share alike and report to the next term of this court all other matters and things being secured until the coming in of said report. Your petitioners Aaron N. Smith and Sarah J. Smith his wife of said County respectfully represent unto your Honor that Jonathan Hollowell late of Said County departed this life in the year 1863 having first made and published his last will and testament which was duly admitted to probate in this honorable Cout at the June term A.D. 1863 thereof. All of which will more fully appear by reference to the record of said honorable court. Your petitioners further represent that said Testator in and by his said will devised to his wife Seaney in and during her natural life all of the lands of which he died siezed possessed except the south west quarte of section eight (8) township five (5) range two (2) west which he devised to his son E. B. Hollowell and the land so devised to his said widow to be divided after her death as follows: His homestead known as the Roberson place he devised to his son Franklin J. Hollowell and all the balance of the lands devised to said widow as aforesaid to be equally divided at her death between his sons Calvin D. and Albert L. Hollowell. Your Petitioners further represent That the lands so devised to his said sons Calvin D. and Albert L. (being all the lands of which said Testator died seized and possessed except the said quarter devised to E. B. Hollowell and the Robertson place devised to Franklin J. Hollowell as aforesaid) consists of the following tracts all lying in said County of Marshall __ by: The West half of Section Five (5) the Southwest Quarter of Section Eight (8) and the north east quarter of the north west quarter and the north half of the south west quarter of said north east quarter of Section Six (6) all in Township Five (5) Range Two (2) West containing in the agregate Five Hundred and Forty Acres more or less. Your Petitioner would further represent that said widow departed this life in the year 1868 and that the said Albert L. Hollowell also departed this life unmarried and intestate in the year 1864 leaving surviving him your Petitioner, Sarah J. who is the wife of her co-Petitioner Aaron N. Smith and Martha Ann Porter who is the wife of Thomas J. Porter, who are his sisters of the whole blood, and his only surviving heirs, and that the said Martha Ann, wife of said Thos. J. Porter, is under the age of twenty-one years, and has no father, mother or legal Guardian living. Your petitioners further represent that said Testator in his said will devised said lands without setting forth by metes and bounds the portion thereof devised to the several legatees; and that they are now desirous of having their portion of the same divided and set apart. The premesis considered your Petitioners therefore pray that said Calvin D. Hollowell and the said Martha Ann Porter and her husband Thomas J. Porter be made parties Defendant to this Petition and cited to be and appear before this Court at the next term to show cause if any they can whey the prayer hereof should not be granted and decree made accordingly and that after due and legal proceedings in the premises your Honor will make a decree directing a division of said land to be made according to the true intent of said willp; and appointing three or five disinterested freeholders as Commissioners for the purpose who shall make said division and make report thereof to the next term of this Court thereafter describing each share by metes and bounds. And for such further or other and general relief as with equity and good conscience may consist and to your Honor may seem meet and proper. And may all proper process issue. Marshall County Miss September the 13th 1862. I Jonathan Hollowell of said county and state of aforesaid considering the mutibility of things do make and publish this my last will and testament thereby revoking all former wills by me at any time heretofore made. First I hereby constitute and appoint James Brooks to be sole executor of this my last will directing my said executor to pay all my just debts and funeral expenses and the legaceys here in after mention given out of my estate. Secondly after the payment of my debts and funeral expenses I give to my beloved wife the following slaves Charles Narsis and her youngest child March and Milly Weyeth Leiniser and Harriet and all the house hold and kitchen furniture that we may be posest of and four mules of her choice and as much other stock as she may chose from the farm also one large wagon and gears one buggy and four choice plows and all my land except the southwest quarter of section eight and township range two west the I posess to have and to hold during her life time or widdowhood unless she may through affection relinquish a part of the above named land to my sons. I gave to my son E. B. Hollowell the south west quarter of Section eight of township five of range two west. I gave to my son Franklin J. Hollowell the land that I now live on known as the Robberson place. I gave to my two Calvin D. and Albert L. Hollowell the ballance of my land including my old place to be equally divided between them. I gave to my son E. B. Hollowell all the notes that I now hold against him for lone money. I gave to my daughter Caroline Saunders one negro slave Jessee and all my railroad stock. I gave to my grand sone William Henry Dickinson one negroe boy named Henry. I gave to my grand daughter Sarah Cocrun one negroe girl named Emeline. I gave Elizabeth Borland, E. B. Hollowell, Calvin D. Hollowell, Albert L. Hollowell, Franklin J. Hollowell, Sarah Jane Hollowell and Martha Ann Hollowell the ballance of my negroe slaves except what has here to fore been given a wy to be equally divided between the last named sons children. In the lot Elizabeth Borland draws she is only to have the use of them during her life time after her death to heirs lawfully begotten of her body. If she should die leaving no such heirs at her death the same lot of slaves to be returned and be equally divided between the last named legatees. I gave to Sarah Jane and Martha Ann Hollowell each one a feather bed and furniture. After the death of my wife I gave to Elizabeth Borland, E. B. Hollowell, Calvin D. Hollowell, Albert L. Hollowell, Franklin J. Hollowell, Sarah Jane Hollowell and Martha Ann Hollowell all the property she may leave to be equally divided between the last named legatees. If there should be any moneys in the hands of executor after paying all my just debts either by sale of property or otherwise it to be equally divided between all my living children. First I give & bequeath to my daughter Sarah Jane Hollowell a certain sorrel mule known as Puss - also two white sows, & two black shoats. 2. Item - I give & bequeath to John J. Harrell for the sole & separate use nevertheless - of my daughter Martha Ann Porter, a bay filly called Mollie & my cow & calf - also two sows & two blue shoats. 3. Item - I give & bequeath to my said daughter Sarah Jane & to the said J. J. Harrell for the use of my said daughter Martha Ann Porter - all my other personal property & effects whatsoever, to be equally divided between them, or sold, as they shall determine & the proceeds equally divided - viz. All monies, credits, estate or effects due to me from any source, my growing crops - other stock not mentioned in above items - including a sorrel horse, - some hogs, my table & kitchen furniture, a wagon & farming tools & utensils. 4. Item - I hereby appoint my said daughter Sarah Jane & Martha Ann - or either of them my Executrices to carry out and perfect this my testament - herby authorizing them to sell any of said property mentioned in 3rd item to effect the purposes of these brequests either at public or private sale - and I further enjoin it upon them to act harmoniously & economically - not to consume this small estate in cost of court - not to go into Probate Court at all or if absolutely necessary only to Probate this will & make a final settlement; - but as far as possible to treat this instrument as a bill of sale, conveying to them the property & in the manner above specified as a deed of gift in consideration of natural love & affection - & I also request said Trustee J. J. Harrell to see that my daughter Martha enjoy to her sole & separate use the property given to her, or the proceeds thereof. Done at my residence Marshall County, Miss. Hollowell and his wife Mary Hollowell of the State of Tennessee and County of Fayette of the first part and Thomas Musgrave of the State of Mississippi and County of Marshall of the second part. Witnesseth that for and in consideration of the sum of one thousand and six hundred Dollars paid by the party of second part the receipt where of is hereby acknowledged by the party of the first part, have bargained and sold and by these presents doth bargain sell and convey unto the party of the second part a certain tract or parcel of Land lying and being in the County of Marshall and State of Mississippi to wit The North East quarter of section number five of Township number Five of range number two West of the base meridian of the Chickasaw cession in the state of Mississippi containing one hundred sixty acres To have and to hold the said Lands and bargained premisis to the said party of the second part his heirs and assigns forever and the said party of the first part covenant to and with the said party of the second part the above named Land and bargained premises they will warrant and forever defend against the claim or claims of all and every other person or persons whatsoever. Also appeared before me the above named Justice of the peace Mary Hollowell wife of Said Wilie D. S. Hollowell who on a private examination separate and apart from her husband acknowledged that the signed sealed and delivered the within Deed on the day and year therein mentioned as her voluntary act and deed freely without any fear threats or compulsion of her husband. Willie D. S. Hollowell 4 slaves conveyed by W. J. Simons. Received of Willie D. S. Hollowell, the sum of fifteen hundred dollars it being a fair consideration for four negroes, namely Sam about the age of sixty years, Fanny aged thirty-eight, Bedy aged five years, Sarah Malisa aged four years. I Weston J. Simons do bind myself, my heirs and assignees forever to warrant and forever defend the title of the above named negroes to Willie D. S. Hollowell his heirs or assignees forever, day and date above mentioned. W. J. Simons (seal). Test: Benjamin Hollowell, Silas Hollowell. The State of Mississippi, Marshall County: Personally appeared before me William Ragan an acting Justice of the Peace in and for said County, Benjamin Hollowell, one of the subscribing witnesses to the above bill of sale who being first duly sworn deposeth and saith that he saw the above named W. J. Simons whose name is subscribed thereunto, sign seal and deliver the same to the above named Wilie D. S. Hollowell, that he this deponent subscribed his name as a witness thereto in the presence of the said W. J. Simons and that he saw the other subscribing witness Silas Hollowell sign the same in the presence of W. J. Simons and in the presence of each other on the day and year therein named.
