LAST WILL AND TESTAMENT I, William Fitzgerald, of Cedar Rapid, Linn County, State of Iowa, being of sound & disposing mind & memory, knowing the uncertainties of life & that death is certain, do hereby make, constitute, & declare this to be my last will & testament, hereby revoking any & all former wills by me at any time heretofore made. ITEM 1 I direct that all of my just debts be first paid from my estate. ITEM II To my daughter, Geraldine Fitzgerald, I give, devise & bequeath the sum of One Thousand ($1,000.00) Dollars, same to be a specific bequest & to be paid to my said daughter before any other distribution is made in my estate. ITEM III All of the rest, residue & remainder of my said estate, I give, devise & bequeath to my 6 children, share & share alike. It should be understood that my daughter, Geraldine, is to have a like share with the others in the distribution contemplated in this paragraph. ITEM IV I hereby nominate & appoint my friend, Andrew J. Murray, of Cedar Rapids, Iowa, as executor of this, my last will & testament. In witness of the foregoing, I hereunto subscribe my name. Murray, the duly appointed, qualified & acting executor of the Estate of William Fitzgerald &, for this his final report, states & shows to the court the following: That he was appointed & qualified as such executor on the 19th day of Jan., 1928. That the said decedent died testate on or about the 24th day of July, 1927, a resident of Cedar Rapids, Linn County, Iowa, leaving no spouse surviving him, & leaving the following heirs at law: William G. Fitzgerald, son, age 48, Mt. Vernon, Washington Mary E. Hanson, daughter, age 45, Cedar Rapids, Iowa Alban F. Fitzgerald, age 41, son, Cedar Rapids, Iowa Margaret R. Pirnie, daughter, age 38, Spanway, Washington Florence L. Peters, daughter, age 36, Cedar Rapids, Iowa Geraldine Fitzgerald, daughter, age 31, Chicago, Illinois That decedent died seized of no real estate; that said estate consisted of numerous accounts, most of which were against persons of doubtful or poor credit; that suit was necessary to be instituted upon a number of said accounts before any collection could be made, and that in some instances no payments were realized even after suit had been instituted. That there has been collected as the assets of said estate, upon the various accounts, the sum of $432.77; that there has been paid as follows: Advanced to Geraldine Fitzgerald - $119.18 To Star Laundry, claim against estate - $29.62 To W.C. Boland, collections percentage, covers legal services in actions vs. Ross, Clauson, Blockinger, Witousek & Berger, including time engaged in trial - $144.25 Paid out as court costs in above cases - $42.06 To Maurice P. Cahill, filing motion & securing dismissal of case of Adams, Admx. vs. William Fitzgerald - $10.00 To Maurice P. Cahill, fees as attorney for executor - $25.00 Court costs in probate matter - $20.75 Total paid out- $390.86 Total receipts - $432.77 Total paid out - $390.86 Balance on hand - $41.91 *** This executor further states that he has made no deduction & makes no claim for allowance of fees. That by the will of said decedent a specific bequest was made to Geraldine Fitzgerald in the amount of $1,000.00; that there are no other assets in said estate save some uncollected, and as this executor believes, uncollectible acounts, which have been delivered to Geraldine Fitzgerald. That the only claim filed against this estate has been paid & voucher for same is attached to this report. Wherefore, this executor respectfully asks that, upon filing the receipt of the said Geraldine Fitzgerald, and proper vouchers showing payment of other claims and disbursements made herein, this final report be approved and his bond exonerated.
