Will of James Cooper 26 March 1858 In the name of God Amen. I James Cooper of the County of Pulaski and state of Kentucky being sick and weak in body but of sound mind and disposing memory, for which I thank God, and calling to mind the uncertanity of human life and being desirous to dispose of all such worldly estate as it has pleased God to bless me with I give and bequeath the sums or manner following That is to say.. . 1st I desire that all the perishable/part of my estate be immediately sold after my death and out of the money arising there from all my inc? debts and funeral expenses be paid. 2nd after that payment of any debts and funeral expenses I give to my son Joel M. Cooper and my daughter Miranda L. White to be their family and equally a certain tract of land to them and their heirs forever, to wit, Beginning at a cedar & rock Standing on the west bank of Cold Weather creek running thence .S56 (w154 poles to a rock on the top of the cliff a white oak poplar & hickory marker S4'w56 poles to a white oak and poplar near a road. thence S? W110 poles to a cucumber hickory and dogwood on the back line......(additional information) ..... Thirdly I give to my sons James W. Cooper, Isaac N. Cooper and my Daughter Elisa Ann Jasper family & equally a sertain tract or parcel of my land to be enjoyed by them and their heirs for ever. to wit Beginning at a cedar and rock on the west bank of Cold Weather creek .... (additional information).... Fourthly I give to my son Ezekial M. Cooper and James E. Cooper my grandson family and equally a certain tract or parcel of my land to them and their heirs forever. to wit Beginning at a cedar and rock corner named in a rticle 2nd and 3rd thence running up the middle of Cold Weather Creek (additional information).. Fifthly, all the rest of my estate both real and personal of what means or kind ....... It may be not herein before disposed of I desire may be eqally devided among my several children and grandson herin before named which I give to them their heirs eccuntory administrators and assigns forever. Lastly I do hereby constitute and approve my friends Joel M. Cooper being of sound mind and disposing memory do make my last will and testiment in ______ and form to say after my decese. first I desire that my funeral expenses be paid and ______ debts. Second I desire my wife Levina Cooper have both my personal and real during her natural life or widowhood. I desire that she keep that estate and use it for the benefit of her children herafter named. to wit Eliza Ann White, Salina D. Cundif, Emity A. Cooper, Weems L. Cooper, David M. Cooper.
