In the name of God Amen the ninth day of September in the year of our lord god one thousand six hundred ninety and six I William Holbrook of Situate in the County of Plimoth in New England being weake in body but of a competent disposing mind and memory doe make and declare this my last will and testament as followeth hereby revoking and making void all former wills and testaments, first and princeablely I do commit and commend my soul to God who gave it hoping in him for an everlasting rest in and throught the merits of Jesus Christ alone and my body to be decently buried by my executor hereafter named and concerning the disposall of my temporall estate which god in his mercy have given me I doe give and bequeath the same as followeth and my mind and will is first that all my just debts be trully payd and funerall charges defrayed by my executor hereafter named------Imprimis I give and bequeath unto my well beloved wife Abigall Holbrook all that estate of household goods which she brought with her in marriage to me that is now left and not worn up and also I doe give unto my good wife all that stock of cattell with which she brought with her at our marriage together. And that when her sayd stock of cattell brought as above said be make good unto her and also that the stock of cattel which I brought with me at our marriage be made good as it then was to my executor hereafter named. That then my mind and will is that all the ---- of our stock of cattell and money cloth and other goods if any be at my decease shall be equally divided between my good wife and my said executor. And further I doe give unto my good wife one green rugg besides what she brought with her by her own. And my mind and will is that she shall have the use of one warming pan and one pair of curtains and one pair of iron andirons during her naturall life and then to be returned again to my executor. And further I doe give and bequeath unto my said wife Abigall Holbrook the sum of three pounds a year in money to be payd to her yarly and every year during her naturall life by may executor, hereafter named, upon condition that my sayd wife shall and doe at my decease or within one week after my decease -----up to my executor after named a writing of agreement made between my sayd wife and my self concerning our estates before our marriage together and also that she doe---- and give up all her right and interest unto and in my estate which the sayd Abigall might or could claim by virture of the abovesayd writing but if at my decease my sayd wife shall so reason to stand to hold her interest in my estate according to the sayd writing made between us before marriage that then my mind and will is that all the abovesayd gifts and bequeaths to my sayd wife shall be void and none effect and she not to receive the same. Item I doe give and bequeath unto my son Cornelius Holbrook his heirs and assigns for ever all my land right of lands and comon priviledges lieing and being in the townshop of Waymouth and the bill of five pounds he oweth to me paying to his daughter Mehitable Holbrook the sum of five pounds in money at her day of marriage or when she come to the age of twenty one yeares or at which of sayd times shall first happen --- Ittem I doe give and bequeath unto my sonn William Holbrook twenty shillings in money and ----- which with what I have formerly given to him shall be the whole of his portion of my estate---- Ittem I doe give and bequeath unto my daughter Elizabeth Buck the sum of twelve pounds in money or other good pay as money to be payd to her within one year after my decease by my executor-- Ittem I doe give and bequeath unto my daughter Hopestill Reed the sum of twelve pounds in money or toher good pay at money price to be payd to her by my executor within one year after my decease----Ittem I doe give and bequeath unto my daughter Mehitable Sprague the sum of twleve pounds in money to be payd to her by her husband out of the twenty pounds which he oweth to me by bill and the reaminder of sayd bill of twenty pounds her sayd husband Jonathan Sprague shall pay unto my executor. Ittem I doe give and bequeath unto my daughter Jane Balcum the sum of twelve pounds in money or other good pay at money price to be payd to her within one year after my decease by my executor and the sayd Jane shall pay forty shillings of syad sum to her daughter ----- Ittem I doe give and bequeath unto my eldest son Samuell Holbrook all the remainder of my estate of whit kinds of what nature soever it may be or wheresoever it be-- And further my mind and will is that if any of my legatees shall so farr declare their dissent with what is above given them as to goe about to break this will by law suits then he or she of them that shall soe doe shall forfit and lose their legacy above given to them, and such forfited legacy to be divided among the rest of the legatees and I doe hereby constitute and apoint my sayd loving son Samuell Holbrook to be the sole executor of this my last will and testament to execute and perform the same as is above expressed.
