In response to your explanation it is PURE Bull, The photograph in question is in my possession and is my personal property, the only one in existance. There are only 2 sites that are authorized to post the photograph.. The 7th Cavalry Associati n and the History of the 7th Cavalry You did not spend the many hours creating the photo and adding the watermarks.. The Historian of the 1st Cavalry Division Did that.. (the photograph is watermarked by the Cavalry outpost System TM). You have admittedly said you "aquired" the photo from some web site years ago.. Enough said please remove the photo and Tune. FYI the the tune was also from the 3-7.. |

Do you know? 1 - That approximately 300-600 no-fault divorces each month (involving career and veteran military members) cause those individuals financial hardships when they discover that they are NOT getting the retainer pay they were told they would be getting. 2 - It is not a ‘pension’ because it is not vested at anytime during your military career. 3 - It is not a bank account, IRA, annuity, or gift that can be divided or borrowed against during your active career service (or even when you are retired after 20 plus years of honorable service). 4 - It is not property because it can not be divided, nor have you ever paid any “property tax” during your active service career as if it were property, nor can you place it in your will, so that upon your death it can go to your next of kin. The govern ent stops payments to you when you die. 5 - Only the no-fault court judge considers it as BOTH property and income and partitions it accordingly for Both deduction considerations. The property division CHOICE helps the no-fault judge assure that the spouse will not impact the county welfare sy tem of the county in which they adjudicate divorces. It is called a Conflict of Interest! 6 - The IRS, DoD, Bankruptcy courts, State tax authorities (who elect to tax active military and veterans), and even the DFAS (that performs the automatic garnishments of the retainer pay as property as dictated by the court) considers the retainer pay as ONLY income! http://www.dfas.mil/money/garnish/fs-qa.htm 7 - It is a condition whereby the military (pentagon) pays the retiree past the 20 plus year time-in-service date a reduced amount of funds under the condition that in an emergency (or when congress decides) you can be recalled to active duty. The age li it is 62 (obvious such individuals would serve in a support function). 8 - The USFSPA Law (Section 1408, Title 10 USC established as PL 97-252 - 8 September 1982) and DFAS action states that upon the completion of a civilian spouse (wife) acquiring ten years of marriage congruent to the military members ten years of active service that upon her completion of divorce action the DFAS will automatically reward that s ouse each month with a percentage of the military member’s retainer pay for the remainder of life (payments stop only when the first of the two divorced parties dies). 9 - The military does not inform its troops of the problem the USFSPA presents to the veteran’s financial future. In fact recruiters, it is believed, deliberately go out of their way to NOT inform new recruits or that CBPO retention personnel do not prov de like data to those considering career service. 10 - It is estimated that somewhere between 80,000 to 100,000 have been effected (but The DFAS - Defense Finance Accounting Service) will not provide the total number effected in spite of the fact that they accomplish the garnishments! 11 - The amount of garnishment is determined by a formula that is figured on the military wage earned at retirement NOT the wage rate at the time of divorce (divorce at ten years of his military service - ie, Captain, and acquire garnishment funds 10 (mo e) years later at his retirement rank of Colonel). 12 - Congress has been indifferent to any consideration for changing the USFSPA law since 1982 yet it is content to increase incentives and bonuses to entice good people into a false career benefits promise. All it takes is a statement of “irreconcilable differences” on her part and the military members pays for life. 14 - The maximum DFAS will garnish is 65% of your military retainer pay. You will then receive the 35% remaining yet will still be obligated to your oath of service to return to duty should congress call . . about 4,000 were recalled for Desert Storm! 15 - Most veterans (who know about the USFSPA) no longer represent the military as the ‘unseen recruiter force’ they once were, but instead, are shamed by the lies of governmental authorities, the disrespect of courts toward those who honorably served for 20 years, and disgusted by the lackadaisical attitude and unappreciative demonstration of the civilian society they protected.
