Cat/Kitten Adoption Contract
This Cat/Kitten Adoption Contract (herein referred to as Contract) is entered into by
Susan M. Embick (Seller)

Seller’s Declaration:
The Seller maintains a FeLV and FIV negative cattery.
All cats in cattery are tested yearly for FeLV and FIV.
All new cats coming into the cattery are FeLV/FIV tested prior to admittance.
Seller is not a veterinarian:
Seller cannot guarantee health of cat/kitten.
Seller can only attest to the general condition and appearance of cat/kitten.
Health Certificate:
If cat/kitten is to be shipped:
Health Certificate charge is included in purchase price (unless otherwise stated).
If Veterinary Health Certificate is waved {for any reason} (verbal conversation binding):
Purchaser assumes all health responsibilities.
Purchaser understands that NO cash refund will be given.
If cat/kitten is to be picked up or personally delivered:
No Health Certificate will be provided:
Cat/kitten is taken on an "as is" basis.
Purchaser understands that NO cash refunds will be given.
If Health Certificate is requested:
Additional $50.00 (non-refundable) deposit will be taken for cat/kitten.
Certificate will be obtained within 5 working days of contract.
If cat/kitten is to be shipped:
Purchaser is responsible for all shipping expenses and carrier.
Purchaser must make arrangements to pick up cat/kitten immediately upon flight arrival.
Signed contract must be in possession of Purchaser. FAX copies acceptable (fax # ____________________).
Health Certificate/FeLV/FIV titter test results will be obtained within 5 working days of contract.
If Veterinary Health Certificate is waved {for any reason} (verbal conversation binding):
Purchaser assumes all health responsibilities.
Purchaser understands that NO cash refund will be given.
Cat/kitten will be shipped within 10 days of Health Certificate, weather permitting.
Purchaser responsibility:
Full Payment, or mutually agreed upon terms, before shipping or possession of cat/kitten.
Purchaser is responsible to fully examine cat/kitten at time of possession:
Seller is to be notified (by phone) immediately upon receipt of cat/kitten.
If not satisfied see item #9.
Purchaser obtain examination from Licensed Veterinarian within 72 hours of possession:
Veterinarian report due to seller within 48 hours of Veterinarian check.
Failure to have examination performed or notify Seller of results of examination:
Holds Seller harmless of any further responsibility.
Refunds or replacement at discretion of Seller (See item #9)
If condition is detected by veterinarian Purchaser has 3 options:
Returning said kitten/cat and receiving a full refund.
Returning said kitten/cat and receiving a replacement kitten/cat of equal value (if available) or,
Keeping said kitten/cat and Seller will pay veterinarian costs up to but not exceeding original purchase price (minus original vet visit since it is the Purchasers responsibility to provide this).
All subsequent veterinary expenses.
Cat/kitten is to be an indoor pet only, outdoor time allowed if on leash or in enclosed, escape-proof area.
Cat/kitten will always be transported in approved carrier.
Purchaser agrees to provide:
Proper veterinarian care, when needed.
Regular attention to dental hygiene.
Adequate light and ventilation.
Warm, dry sleeping quarters.
Exercise space and climbing posts.
Adequate human contact and affection.
Disease and parasite free environment.
Separate food and water dish:
Proper, professional diet in proper amounts.
Fresh, cool water available at all times.
Litter Habits:
Seller does not guarantee perfect litter habits.
Purchaser agrees to provide separate and individual kitty litter box:
Litter will be changed frequently, to ensure sanitary and positive litter habits.
If Purchaser cannot or does not wish to retain possession of the cat/kitten {for any reason}:
Seller must be notified within 24 hours of decision.
Seller will be given the right of first refusal.
The Purchaser is responsible for all transportation, carriers, and other expenses.
If returned within 10 days of original receipt of cat/kitten by Purchaser:
Kitten must be returned in re-salable health and condition.
Full refund minus expense of:
Veterinary exam, FeLV/FIV test and veterinary or parasite treatment, if necessary.
Payable by check or money order within 30 days of receipt of cat/kitten by Seller.
If returned after 10 days of original receipt of cat/kitten by Purchaser:
No refunds or replacements implied.
If cat/kitten is found to have contracted a communicable disease or parasites, it is the Purchaser’s responsibility to PAY any and all veterinary expenses relating to returned cat/kitten and resulting damage to Seller’s cattery.
This cat/kitten may NOT be sold, given, or co-owned to a third party without notification of Seller.
This cat/kitten may NOT be sold/given to any pet shop, research laboratory, boarding facility, kennel facility or any/all similar types of facilities engaged in the business of animals for any reasons/purposes.
This cat/kitten has been sold as a PET BREEDER SHOW SHOW ALTER.
If #12 indicates that this cat/kitten is purchased as a PET, it is agreed that this cat/kitten be spayed or neutered:
On or before the six month birthdate, or within 30 days if over 6 months.
Upon receipt of veterinarian altering certificate, registration slips will be provided.
If #12 indicates that this cat/kitten is purchased as a BREEDER:
Purchaser agrees to breed ONLY to a Registered BENGAL cat.
Cat/kitten will be bred only to another cat tested to be FeLV/FIV negative.
Purchaser agrees no cat/kitten from any breedings with the purchased cat/kitten be sold to any pet shop, research laboratory, boarding facility, kennel facility or any/all similar type facilities engaged in the business of animals for any reasons/purposes.
If #12 indicates that cat/kitten is NOT sold for BREEDING, AND IT HAS BEEN BRED FOR ANY REASON:
THE PURCHASER WILL BE LIABLE FOR THE FINE OF NO LESS THEN $10,000.
THE PURCHASER WILL BE RESPONSIBLE FOR ALL RESULTING LITIGATION EXPENSES.
OWNERSHIP OF SAID CAT AND ALL OFFSRING SHALL BE RELINQUISHED TO SELLER.
If #12 indicates that this cat/kitten is purchased as SHOW:
Purchaser assumes all responsibility for acceptance of cat/kitten.
Cat is guaranteed to obtain the status of CHAMPION with the proper care and presentation.
If #12 indicates that this cat/kitten is purchased as SHOW ALTER:
Purchaser assumes all responsibility for acceptance of cat/kitten.
Cat is guaranteed to obtain the status of CHAMPION with the proper care and presentation.
Cat is to be ALTERED on or before reaching 6 months old (see #15).
