The Purchaser agrees to pay the Seller one of the following:
A stud service fee of __________________.
A pick of the litter kitten.
A stud service fee of ________________ and a kitten back (PICK OF LITTER SECOND PICK OF LITTER OTHER)
If the Seller is to receive a kitten back, the Seller may visit the kittens when they are approximately six weeks of age. Seller’s choice of kitten will be released upon request, providing it is no younger then twelve (12) weeks and no older then fourteen (14) weeks. The Purchaser will furnish the first immunization, and any paperwork to register kitten.
If the Seller is to receive a stud fee, said fee is due before queen is picked up from Seller’s premises.
Upon receipt of either kitten and/or fee, the Seller will provide a copy of the stud’s pedigree and a signed Litter Registration form.
If only one (1) kitten survives, the Purchaser may retain the kitten and pay a stud fee of ____________, or release the kitten per the agreement.
If the initial mating proves unsuccessful, two return services (one if queen becomes pregnant on the first return) are guaranteed. If the queen still fails to conceive, Purchaser will pay the stud owner $5 per day of boarding for all three services; this amount is to be paid in full no later then four weeks after final mating, and is in lieu of a kitten and/or stud fee.
If ownership of queen changes before contract is fulfilled, Purchaser is responsible for a stud fee of ____________, due before ownership is transferred. (only applicable if fee included a kitten back).
SOLE RESPONSIBLILITY OF THE ABOVE NAMED STUD IS TO IMPREGNATE THE ABOVE NAMED QUEEN. HE AND THE SELLER HAVE NO RESPONSIBILITY REGARDING THE NUMBER, QUALITY, SEX, OR SURVIVAL OF THE RESULTING KITTENS.
In the event that the Purchaser is found to have violated any of the terms and conditions of this contract, Purchaser shall be liable to Seller’s Cattery for damages in the amount of the Service Fee of said stud, plus liquidated damages in the amount of $100, plus costs from litigation of this contract.
