CRIMINAL COMPLAINT I, Michael Lynn Mincy, wish to make the following complaint: (1.) That in the early morning hours of Saturday February 9, 2002 at exactly 2:28am to 2:30am cst, a Haltom City Police officer commited an act of "extreme" provocation to "violence" by "deliberately" parking "on the street" outside and only about 30 feet from my bedroom window, as he conducted "unlawful survelillance" by such an act from 2:28am to 2:30am, 2/9/2002. This he did by starring at me through my partially closed "bed-room" window blinds, even as he saw me raise the blinds to watch him commit such an act. (2.) And "again, just 45 minutes ago, this "same" Haltom City Police officer repeated the same "act of provacation" in front of this home at 5425 Mallory Drive, Haltom City (Fort Worth), Texas, when, "as" I stepped out of the house to pick up the Sunday edition of the Fort Worth Star-Telegram newspaper, this Haltom City police officer had driven down Mallory Drive (west to east), then upon "seeing me", stopped his "white" Haltom City police car with all City markings and fully equiped with all devices such as color lights on the top of the car and sirens mounted on the front of the car and so properly identifying it "as" a police car belonging to the Haltom City Police. This Haltom City officer "unlawfully" conducted "surveilllance" on me, and "continued" his attept at "provocation" to violence. This again is the "second" morning in a row of such activity on this officers' part, but is yet only a small portion of the number of times that the Haltom city Police Department has attepted to provoke any action on "my" part, which they can then use to "justify" whatever "unlawful" activity they have commited in the past, and are "now" planning to commit "now". This is "exactly" the "same" tactic they employed in the early morning hours of February 1, 2001 (1:45am 2/1/2001) [ See below]. They are now doing the "same" thing, "this" time they do so by "invasion" of my household. This officer is I believe, now in violation of the following US Crimes: At least one (possibly more) UNKNOWN Haltom City, Texas, Police officers, with "full police powers" given him (and/or them) by the State of Texas, have caused "real" persoanl and statutoral, and constitutional injury; and that (2) the City of Haltom City, Texas, as a matter of municipal policy and custom haved caused "real" and constitutional injury, as the employer of UNKNOWN Officer (Arrington v Dallas; US 5 CA 241; 1992), all in violation of 18 USC $$ 241, 242, and 42 USC 1983, when they "knowingly and with the purpose to do so", conspired and have actually deprived me, Michael Lynn Mincy, of my United States rights to: 1. The right to be free from "unlawful" seizure and threats of "unlawful" seizure of our "property" and "persons". (a) "seizure" of "property", MINCEY v. ARIZONA, 437 U.S. 385 (1978); (b) and in "seizures" of persons, I am "deprived" of my US "rights" of protection of his Fourth Amendment rights against "unreasonable" seizure, not even for "detention", through the Fourteenth Amendment, against "unreasonable" seizures without reasonable suspicion of criminal activity", U.S. v. Bass (1994) 629 N.E. 2d 592, when at 2:30am, CST yesterday on 2/9/2002, and again this morning at 4:45am, 2/10/2002, and so I "at least" suffered the crime of "unlawful surveillance" and "provocation" to "violence", and "also" because I fear for my "physical safety". This police officer, and other Haltom City officers are now in the process of and in the past have committed many similar acts of harassment. All in violation of 18 USC 241, 242, and 42 USC 1983. When at 1:45am, CST, February 1, 2001, UNKNOWN City of Haltom City, Texas Police officer and employee of Haltom City Police, driver of police car # 445, arrived about 1:35am, after driving down the Denton Highway (377) and returning shortly afterward about 1:35am, and drove passed me (Mincy) on Mallory Drive (westward) slowly, then proceeded westward on Mallory Drive and away from me (Mincy) first to Revere Drive, then north on Revere Drive. Since my cars engine was still running, and I had my "headlights" still on, I proceeded to drive behind this police car a short distance up the steet. Seeing this officer turn away from me, I (Mincy) traveled from this point west and "away from" the police officer, and onto Jane Lane, turning back east on Stephanie Drive and so made a drive around the block, stopping at Stephanie and Revere Streets. There the UNKNOWN Haltom City Police officer was "returning" a "third" time, and waited for me (Mincy) to begin my (Mincy) turn onto Revere Street, and when I (Mincy) did, only "then" did the UNKNOWN police officer turn on his "emergency" lights and pursued me (Mincy) back to my residence at 5425 Mallory Drive. I (Mincy) parked my (Mincy) car partly in the driveway there, and partly out on the street, becaused I feared for my "physical safety". This police officer, and other Haltom City officers then surrounded me and detained me as I sat in the car for ten (10) to fifteen (15) minutes, for no reason other than harassment. In violation of 18 USC 241, 242, and 42 USC 1983. 2. The right to be free from threats of "seizures", and other "police action" based on "less" than "probable cause" or "less" than "reasonable suspicion". MINCEY v. ARIZONA, 437 U.S. 385 (1978), and to be "free from" being "blocked" to any exit to "freedom" and showing an "extreme" amount and "unlawful" use of "force" when at 1:40am, Thursday morning, February 1, 2001, UNKNOWN City of Haltom City, Texas Police officer arrived, confronted me, Michael Lynn Mincy , in the car I was driving, then parked at my place of residence. In response to demands from this Police officer to see my (1) Driver's license and (2) car's Insurance papers, I asked "why" was he asking for it, and he replied, "I always' do a 'license search when I see a 'suspecious' car parked....it's 'routine' for 'me'...." By this time, about 1:45am, a total of "four" (4) Haltom City police cars with four (4) to six (6) Haltom City police offers, were "blocking" me (Mincy) in, and all other traffic out. This caused much "real" fear in me of "physical harm". In violation of 18 USC 241, 242, and 42 USC 1983. 3. The right to be free to live a life to "pursue Happiness....". BUTCHERS' UNION CO. v. CRESCENT CITY CO., 111 U.S. 746 (1884), "...the right to pursue any lawful business or vocation, in 'any manner' not inconsistant with the equal rights of others." ; and [ it is ] illegall[y] to [deprive] [others their] rights to "the full range of conduct, which the individual is free to pursue, and cannot be restrained, except for a proper governmental objective", as protected by the Liberty rights in the Fifth Amendment, and applied through the Fourteenth Amendment. Bolling v.Sharpe (1954) 347 U.S. 497. Including the United States "right" to be free from "constant" Harassment by Police officers. And when this is only the "latest" attempt by Police officers, and employess of the City of Haltom City, Texas, to engage in "unlawful" activity against myself "and" other members of my family, by depriving me and my family or one of it's members, of my and "our" United States "rights", (United States Code, 18 USC 1514(c)(1)) In violation of 18 USC 241, 242, and 42 USC 1983. 4. The right to be free from "harassment". United States Code, 18 USC 1514(c)(1), "a course of conduct directed at a specific person that causes substantial emotional distress in such person and serves no legitimate purpose.", because this is only the "latest" attempt by the City of Haltom City, Texas, to engage in "unlawful" activity against this family, by depriving this family or one of it's members, of it's United States "rights", In violation of 18 USC 241, 242, and 42 USC 1983. STATEMENT OF EVENTS OF Thursday, 2/1/2001 1. After several minutes, Haltom City Police officer Ernie, asked politely " ...are you the one that lives here?", and I answered "Yes". Then officer Ernie said, "Thats right, you're the one with the sick mother....?" "Thats right!", I said. Then I told officer Ernie that "I just got back home from several hours of shopping" when the other officer arrived and began this incident. Then I asked officer Ernie "whats the reason" for this, officer Ernie said, "I don't know...I just got here....Can you prove that?" "Sure, here's my 'list' and 'notes' I made along the way!" Then officer Ernie took my 'notes' I scribeled on a small note pad, and he said, "Just a minute.... I'll be right back!" After he huddled together with the other officers for some time, the UNKNOWN officer who began the whole affair, brought my driver's license back, and said that he was just "checking all suspecious cars". Even after that, two police cars remained in the middle of the street, and blocked completely any traffic up or down Mallory for about 10 minutes. Then they finally drove away about 1:55am. 2. This is only the "latest" attempt by the City of Haltom City, Texas, to engage in "unlawful" activity against this family, by depriving this family or one of it's members, of it's United States "rights", ALL in violation of 18 USC 241, 242, and 42 USC 1983.
