Land Ordinance (Cap 68)

The cabinet is empowered to give general or specific directions to the Director of Lands & Survey on the alienation of state land. Now only the CM can give such directions.

The Cabinet is given the power to direct the terms, conditions, conveyance and restrictions applicable to the alienation of town land by public auction. Presently such powers are vested in the CM.

New definition of "land" is inserted in the ordinance to be consistent with the National Land code 1965.

The Mining Ordinance 1960

The CM must obtain Cabinet approval before alienating state land for mining purposes. Presently, he doesn't have to.

The Forestry Enactment 1968

The CM can only make an agreement on related forestry matters with the approval of the Cabinet. Presently, he can enter into agreement without Cabinet approval.

The forestry director must obtain the written approval of the Cabinet before issuing any licence for logging in forest reserve or state land. Now the power to grant such approval to the director is vested in the CM.

The CM is empowered to make rules for registration, licensing and regulation of other timber processing mills apart from sawmills.

A second post of deputy director of forestry created for the management of forest resources on sustainable basis in compliance with guidelines of International Timber Trade Organisation (ITTO) by the year 2000.

The Delegation of Powers Enactment 1963

New section 2A to accommodate the transfer of certain powers to the CM on forest, land, mining and Yayasan Sabah to Cabinet.

The Sabah Foundation Enactment 1966

The Yang di-Pertua Negeri is given the power to appoint the chairman and the other members of the board of trustees so as to be in line with similar appointments of other statutory bodies in the state. Now the CM is automatically the chairman and the other members are appointed by him only.

The Cabinet is empowered under a new section to give the board of trustees general directions which are not inconsistent with the provisions of the enactment. Presently, there is no such provision becuase the CM as the chairman provides the link between the Cabinet and board of trustees.


Tabled in cabinet 17-18th June 1996. As expected, most people voted according to their political affiliations. But a few raised eyebrows. Kong Hong Ming abstained on one matter while Jahid Jahim even voted against the BN on another matter. Result: immediate suspension. Meanwhile Kadoh Agundong was "stranded by flood in his constituency."
