  Welcome to Thomas H. Kimbell Website

It was created in honor of Thomas H. Kimbell because of direct negligence on part of the so-called United States "Judicial System". You are invited to read to discover how many innocent people are sitting on death row for crimes they did not commit.

  On June 15, 1994, a viscious crime was committed and 4 innocent people payed the price with their lives. It happened just a few miles from where Tom lived and daily he walked past the road on which it occurred. The day that the murders were committed Tom had gotten a ride to and from town. The authorities gained knowledge of Tom sometimes walking along Route 422 and arrested him upon a charge of theft for a bicycle, but, not before endlessly interigating our mother and father with questions concerning this murder. They held him in the jail for 1 month for the bicycle charge and then dropped the charges against him. While he was incarcerated, the county officials along with the state and city police departments checked word of mouth stories concerning these murders and took DNA samples from Tom's body and his clothing. Through every test, no match could ever be made connecting our brother with this horrible crime. However, the father of the victims was known to have blood of the young girls on his hands and clothing and was never tested for the DNA samples.

After almost 2 years, the state and county lawyers and officials decided to proceed with Tom's trial. Many types of evidence were collected by only those which portrayed my brother as the killer were allowed into court. They allowed gruesome pictures of the innocent children killed to persuade the jury to convict Tom. However, they didn't admit some evidence, such as the testimony of a family member of the deceased, which directly appointed the husband/father of the deceased family as the killer.

They claimed that due to her (the family member's) mental disorder since the crime she had made several statements to the investigating officers and that the most crutial statement (one of which was audio taped and the other was a signed statement ) should not be permitted into the courtroom for the jury to hear because of the laws that were in effect at the time of the trial. This evidence was also not produced to my brother's attorney from the lead investigating officer until almost 8 months after the attorney was appointed to the case. The only reason that they did produce it was because the attorney knew of this evidence and the prosecuting attorney (which was the Deputy Attorney General for the State of PA) gave it to the attorney because he knew it was against the Law to withhold evidence.




 
 
  Upon January 28, 1999, Judge Glenn McCracken, Jr., denied Tom's petition for an appeal or reversal of the verdict.
