Legal In January 1995, Albania approved a new Penal Code, fully decriminalizing consensual relations between men. Until then, the penalty for same-sex consensual homosexual relations (= sex between men) was up to ten years imprisonment. This result was mostly thanks to the gay association Shoqata Gay Albania (SGA), which began operating in 1994. Founded by Genc Xhelaj, the organization then operated illegally and under great danger. But enduring several arrests and harassment from the police, they continued their lobbying effort both nationally and internationally. With the current civil war situation in Albania, it is very difficult to say how the current situation is for homosexuals. Travellers are of course recommended they show utmost caution.
