Failure to Declare Weapons
It is published CCRA policy that any weapons
that are not declared at
Primary Inspection and are subsequently discovered
will be immediately confiscated. One will not even be given the option to
return the item to the states
If upon subsequent search of your vehicle an item (ie a machete) is found that the
CCRA claims to be weapon, and threatens
to confiscate for failure to declare, it is imperative to
remind the CCRA Officer that only
the Criminal Code definition of a weapon is what governs the situation.
It is imperative to stress to the
agent that the (ie) machete is not a weapon, because
you would never use it as a weapon.4>
It is possible the agent will confiscate it anyway, but you will thus have a
claim for compensation for the illegal confiscation of your lawful property.
