LAST WILL & TESTAMENT OF SAMUEL GIBSON OF GREEN TOWNSHIP, INDIANA COUNTY, PENNSYLVANIA. Will Book 2, Page 343, #1513, Dated April 27, 1848.

IN THE NAME OF GOD, I, SAMUEL GIBSON, considering the uncertainty of this mortal life, and being of sound mind and memory (Blessed be Almighty God for the same), do make and publish this my Last Will and Testament, hereby revoking and making void all former Wills by me, at any time, here to fore made.

FIRST, I direct that my body be decently interred, and that all my debts and funeral expenses be paid as soon as possible after my decease, by my son Josiah.
ITEM, First, I give and bequeath to my beloved wife, MARY GIBSON, all the household and kitchen furniture , together with all the beds and bedding, except my clock, which I give to my son Josiah, and further, I direct , that my said wife, Mary Gibson, provided she shall survive me, shall remain on the premises, where I now live, and that my son, JOSIAH, shall provide for her a comfortable house, good boarding, sufficient clothing, and every thing necessary to make her comfortable during her natural life, which is to be in lieu of her dower at common law, if she shall so elect, otherwise, my said wife, Mary, shall have her living out of the proceeds of said land. I give and bequeath to my son, WILLIAM, One Dollar in cash; and to my son, EZEKEIL, I give and bequeath One Dollar in cash; to my son, JOHN ALLISON, I give and bequeath One Dollar in cash; and to my son, HIRAM, I give and bequeath One Dollar in cash; and to my daughter, MARGARET LOCKET, I give and bequeath Fifty Dollars in cash; and to my daughter, AMANDA, I give and bequeath Fifty Dollars in cash. The said several legacies, or sums of money, I will and order to be paid to the said respective legatees within one year after my decease, by my son, Josiah Gibson, and further, I do give and devise, to my son Josiah Gibson, and to his heirs and assigns, all the messuage, tenament or tract of land, on which I now live, situate adjoining lands of Martin Myers, McKendricks heirs, and others, in Green Township, Indiana County to hold to him the said Josiah Gibson, his heirs and assigns forever, and my express will and desire is, and I do hereby order and appoint, that of any difference or dispute shall arise concerning any gift or bequest in this my will, that then no suit or suits shall be brought, commanded or prosecuted for and concerning the same.

But, the same shall be referred wholly, to the award and determination of two of my neighbors, John Barr, and William Evans, with Power to choose a third person, and if from any cause the said, John Barr, and William Evans, or either of them should not be able to attend, or act in the premises, then my said son Josiah, shall choose two other arbitrators, with power to choose a third person, what the said arbitrators, or a majority of them shall order, direct or determine, therein shall be binding and conclusive to and on all and every person and person therein concerned. And lastly, as to all the rest of my personal property, that I may be posed of at my decease, I give to my son Josiah, whom I hereby constitute and appoint sole Executor of this my Last Will and Testament.

IN TESTIMONY whereof I, Samuel Gibson, the testator have to this my Will, set my hand and seal this 27th day of April, in the year of out Lord, One Thousand Eight Hundred and Forty Eight.

Signed, sealed, published and declared, by the above named Samuel A. Gibson, to be his Last will and Testament in the presence of us, who at his request, and in his presence, have subscribed our names as witnesses, there in to in the presence of each other.

( CODICIL )

WHEREAS I, Samuel Gibson, of the township of Green, in the County of Indiana, have by my Last Will and Testament, in writing, duly executed bearing date the 27th day of April, A. D. 1848, given and bequeath to my daughter, Amanda, Fifty Dollars in cash to be paid to her by my son Josiah. Now I, the said Samuel Gibson, being desirous of altering my said Will, so far as relates to the legacy, which I will and direct to be annexed as a codicil to my said will, and taken as a part there of: and I do hereby revoke the said legacy by my said will given to my said daughter, Amanda, and I do give to her, my said daughter, Amanda, One Dollar in cash only; to be paid by my son Josiah, within one year after my death, and I do ratify and confirm my said will in every thing except where the same is hereby revoked and altered as aforesaid.

In Witness Whereof I, Samuel Gibson, the testator have to this codicil set my hand and seal this 6th day of March, A. D. 1852.

INDIANA COUNTY

Be it remembered, that on the fifteenth day of June, in the year of our Lord, one thousand eight hundred and fifty seven, before me, John H. Lichteberger, Register for the Probate of Wills and granting Letters of Administration, in and for said County, personally appeared James Bailey and William Evans, Esq. subscribing witnesses to the foregoing instrument of writing, purporting to be the Last Will and Testament of Samuel Gibson, late of the Township of Green, in the County of Indiana, deceased, who being duly sworn according to law,deposeth and say that they were personally present, and saw and heard the Testator, Samuel Gibson, sign, seal, publish, and declare the foregoing instrument of writing as and for his Last Will and Testament, and that they signed their names as witnesses to said instrument of writing in the presence of the said testator, and at his request, and in the presence of each other, and at the time of signing the same, he, the said testator, was of sound and disposing mind, memory and understanding, to the best of their knowledge and belief.
