National Carolina Genealogical Journal, Feb 1983, page 43 Article on divorces and separations granted by the NC Assembly
Rebecca petitioned for divorce from Gray Ruffin - 1826 (uncontested)
A divorce of "bed and board" was granted. (The other kind of divorce was "complete", granted only for adultery or impotency) The "bed and Board" divorce could have been requested for "cruel treatment, endangering her life, making her condition intolerable".
The petitioner (wife) had the right to 1/3 of the spouse's annual profits or income from his estates as a form of alimony.
The names of the children were discovered in the deeds as they sold shares of the Rebecca Ruffin estates. There is a fifth child, but the deed has not been discovered, and it was probably a married female.
William Herbert married Elizabeth Ruffin in Halifax Co., NC 27 Oct. 1834. The census records for 1850, 1860, & 1870 for Haywood Co., TN lists William's wife as Elizabeth.

William Herbert, his mother Anne Curlin, & Anne's husband Thomas Curlin sold some land in Halifax Co., NC in 1845. This is probably when they moved to TN. William & Elizabeth's oldest child was John A. Herbert John moved his family to MS in the late 1860s. They were in Grenada Co., MS in 1870. In 1880 they were in Carroll Co. where they stayed.
