He married Margery Wheeler Apr 13, 1618 in Thornbury, Gloucester, England (St. Mary the Virgin, Thornbury, parish register.), daughter of Abel Wheeler and Jane Shephard. She was born Abt. Apr 1600 in Thornbury, Gloucester, England, and died Feb 13, 1672/73 in Braintree, Norfolk, MA she was 72 (Braintree Town records, 12m 11d 1672 also 12m 13d 1672).

BAPT & MARR: St. Mary the Virgin, Thornbury, parish register "Thomas Tayer" Godfathers were Thomas Gibbs and William Dimery. DEATH: Braintree Town records, gives both 4m 2d 1665 & 2m 4d 1665, “old Thomas Thayer dyed.” Thomas Thayer first appears in the records in America on 24 Feb 1639/ 1640 when he was granted land at Mt. Wolleston (now Braintree) Massachusetts. Thomas and his family came on the Blessing on 8 April 1637. Thomas Thayer wrote his will 24 Jun 1664, Vol. I, p 454 P Ct. Boston. A modernized copy is shown in the 1874 Thayer Genealogy. Suffolk County Wills has an extract in the original. A combination of these reads: " I, Thomas Tayer, of Brantrey, in Suffolke, in the Massachusetts Colonie, of New England, Shoemaker, being in perfect health and memory, praised be to God, this 21 of June, A.D. 1664, doe make this last Will and Testament as followeth: Imprimus I give vnto my wife Margery, that now is, all my lands, goods and estate, whatsoever, situate, lying and being in Brantrey, aforesaid, during the term and tyme of her natural life; and after her decease I give and bequeath vnto my sonne, Thomas Tayer, his heiers & assigns, all my ground lying and being over the Monotoquot River, within the limmitts of the said town of Brantrey, with the tymber or other wood growing or fallen vpon the same with the other the appurtenances, part of which ground he hath allready in his possession. Item, I give and bequeath vnto Ferdinando Tayer, my sonne, his heiers and assignes, next and ymmediately after the decease of Margery, my said wife, my house and orchard therevnto belonging, lyeing, and being in Braintrey aforesaid, with all the planting ground and pasture lyeing betweene ye high way and River called Monotoquot River, aforesaid, and on the other side of the high way from the south sid of the barne to the end of the lotte. Further my will and mind is that the said Fardinando, my sonne, shall have the free liberty to cut, fall, and Carry away, fire wood for his and his now wife's own burning, of and from my lot, called Twenty acre Lotte, during his and his said wife's life. Item, I give and bequeath vnto my sonne, Sidrache Tayer, his heiers and assignes, next and ymmediately after the decease of my said wife, Margery, a parcel of ground in Brantrey, aforesaid, which shall begin at the corner of the barne next his dwelling house and shall run with a straight line to the vpper end of the lott. Item, I giue and bequeath twenty acres of land more vnto the said Sidrach, his heiers and assignes, next and ymmediately after the decease of my said wife, Margery, which land lyeth in Brantrey, aforesaid, next vnto the ground of Henry Neale, provided he, his heiers, and assignes, prmit and suffer my son Fardinando & his now wife, to take wood thereof for their owne burneing during their naturall lives according as is before expressed. Item, I giue and bequeath all my goods and Chattells vnto my grand Children, to be equally divided amongst them. And lastly, if any of my said Children shall appear to be discontented & murmor at this my last Will and Testament, then my will and minde is, That any such child, one or more of them shall haue but 5s. for their portion or potions of any such Child or Children murmoring and discontented as aforesaid, shall be equally divided amongst the rest of my Children and Grand children. And I do nominate and appoint my said wife Margery & sonne Fardinando, to be my executors, of this my last Will and Testament; and all other former Wills and Testaments and bequeaths, I do hereby utterly revoke and make void forever by these presents. In witness whereof, I have hereunto set my hand and seal, the day and year above written.

On the other side of the original will was an unsigned statement which was not recorded. It read: “Wee, Ferdinando, Thomas, and Sydrach Thayer, children of Thomas Thayer, deceased, That is to say upon Aduice & counsell, The Abouesayd Ferdinando, who by his fathers will is made executor [of] his fathers last Will and Testament seeing some Inequality, especially in the behalfe of his elder brother, with some litell to Sydrach, in consideration that brotherly loue may continue, Doth grant to his beloued brethern all the land aboue the highway excepting Two acres, which two acres is bounded on the line running from the highway from the south side of the land where the barne stood and so upon a streight line to the south corner of goodman Prays line; all on the south side of this, to bee to Sydrach, to him & his heirer for euer, and the said Ferdinandoes to come Inward towardes Thomas from that line seuen rods [ ] broad towards Thomas, and the rest bee to Thomas, to his heires execqutors and assignes foreuer. This being a full and unanimous agreement betweene the three brethern. And wee, the Aboue said Thomas, Ferdinando & Sydrach doe heerby engage ourselues, Joyntly and seuerally, for himselfe, neuer to make any disturbance, either of other any expression in our fathers will notwithstanding.
Witnesse our hands this thirtieth of June one Thousand six hundred sixty fiue.”

Notes for Ann Freebury:
She is probably widow of Nicholas Freebury whom Savage mentions as being at Casco about 1680, or of Richard Friebury Sr. who was taxed at Pemaquid in 1687 (Reg. 32:314). No record of her marriage or death is found except in the court records at Boston which give much information on her life in Mendon and the violent domestic quarrel with Ferdinando Thayer and his sons to whom he deeded his property, partly at least to prevent her from acquiring it. (See Records of Supreme Court of Judicature #4657, 4845, 4703, 4727, in Suffolk Co. Court House, Boston). Ann Freeberry (or Freebury) was an "eastern woman", that is, from Maine, probably driven here by the Indian Wars; she was born about 1648 according to her own deposition. She departed from Ferdinando Thayer after 1700, when he made an agreement "to be shaft of her" after she testified he and his sons sold liquor to the Indians and that he had deserved to have his house burnt by the Indians during the War and that it would occur again if he did not stop trafficking with them, that he had tried to starve her by not providing food in the house, etc.

Will dtd 3 Oct 1754; inventory 5 Jan 1755; In the name of God, amen, this third day of October 1754, l, Isaac Thayer of Mendon, county of Worcester, in his Majesties Province of Mass. Bay in New England, husbandman being aged and weak in body but of perfect and sound mind, judmement and memory, thanks to God, therefore calling to mind the mortality of my body and knowing that it is appointed for all men to die, do make and ordain this my last will and testament, that Is to say principally and first of all I give and recommend my soul unto ye hands of God that gaveth my body, I recommend to the earth to be buried in a decent Christian manner at the discretion of my executers hereafter mentioned, nothing doubting but at the general resurrection I shall receive the same again by the mighty power of God and as touching such worldly states where with it hath pleased God to bless me in this life after my past debts and funeral charges are paid and satisfied I give demise and dispose same in the following manner and form.

First of all I give and bequeath unto my beloved son, Moses Thayer of Mendon and to his heirs and assigns forever after my demise all my homestead land as it tieth together consisting of a lot 80 acres with all the buildings thereon erected except an allowance through the same for a third road excepting also a strip of land on north side of said farm which hereafter mention together with about 7 1/2 acres of land situated lying and being in Bellingham the bounds thereof may morefuIIy appear in reference to the records being provided the above Moses Thayer, his heirs or assignees shall and do willfully pay or cause to be paid the ? which I shall hereafter mention and order him the said Moses Thayer to pay together with what I have already given him.

To my beloved son, lsaac Thayer, of Bellingham I give after my decease and to his heirs and assignees forever 40 shillings, lawful money, to be paid by my son Moses Thayer three years after my decease besides what I have here fore given him.

To my beloved son, Ebenezer Thayer of Mendon and his heirs and assignees forever I give after my demise 13 pounds, 6 shillings and 8 pence lawful money to be paid by my aforesaid son, Moses Thayer, in the space of two years after my decease besides what I have already given him.

Item to my beloved son John Thayer, of Mendon and to his heirs and assigns forever after my decease 6 pounds, 13 shillings, and 4 pence law full money together with what I have already given him to be paid by my beloved son, Moses Thayer, in the space of three years after my demise.

Item to my beloved son Nathaniel Thayer of Mendon and to his heirs and assigns forever I give after my demise all that piece of swamp I here to for purchased from heirs of Josiah Thayer of Mendon adjoining to the said Nathaniel Thayers homestead together with about 8 acres of upland lying and being in Bellingham on the southeasterly side of a called Saddleback Hill and as the record of said congregation may fully appear together with what I have already given him.

Item to my son, Samuel Thayer, of Mendon and to his heirs and assigns I give after my demise together with what I have already given him a small piece of land on the north side of my homestead building westerly of Aaron Thayers land 6 rds and southerly on my homestead lands aforementioned and easterly 6 rds on a 3 rd road and northerly on said Samuel Thayer’s other lands with a straight line from comer to comer upon the south side of said strip or piece of land.

Item to my beloved son, Joseph Thayer, of Douglas and to his heirs and assigns forever I give after my decease 6 pounds, 13 shillings and 4 pence lawful money to be paid by my beloved son Moses Thayer, in a space of two years after my decease together with what I have already given him.

Then to my beloved son, Ichabod Thayer, of Mendon and his heirs and assigns forever I give after my decease 13 pounds, 6 shillings and 4 pence lawful money to be paid by my son, Moses Thayer, in the space of 1 year after my decease together with what I have already given him.

Item to my beloved daughter, Comfort Keith, the wife of James Keith of Uxbridge and to her heirs and assigns forever l give after my decease 4 pounds lawful money to be paid by my son, Moses, in a space of three years after my decease with what I have already given her.

Then to my beloved daughter, Mary Keith, wife of Gershom Keith of Uxbridge and to my beloved daughter, Jerusha Carrary, the wife of Bing Carrary of Uxbridge and to my beloved daughter Patience Chiles, wife of Benjamin Chiles of Woodstock and to their heirs and assigns forever I give after my decease with I have already given them, all my indoor valuables or household goods to be equally divided between them the said Mary Keith, Jerusha Carrary and Patience Chiles also I give to my daughter Jerusha Carrary and her heirs and assigns 1 cow out of my outdoor moveables after my decease.

Item to my beloved Isaac Thayer's children and to their heirs and assigns given after my decease the full and just sum of 8 pounds 13 shillings 4 pence divided between them and to be paid unto them respectively by my son Thomas afordsaid within 6 months after my decease or otherwise as they shall come of lawful age.

Item to beloved grandson, Jesse Thayer son of John and his heirs and assigneed I give after my decease the full and just sum of 6 pounds, 13 shillings and 4 pence lawful money to be paid unto him by my son Moses Thayer aforesaid within a space of 6 months after my decease.

Item to the four children of my daughter, Marcy Thompson, deceased former wife of David Thompson and Mary Scott the wife of Samuel Scott, Abigail Wright the wife of Samuel Wrlght and Poses Darling wife of Enoch and to their heirs and assignees I give after my decease 10 shillings apiece to each in lawful money to paid by my son Moses Thayer, aforesaid in space of 1 year after my decease. Also, I give after my decease unto the children of my granddaughter, Marcy Thompson the wife of Esra Thompson deceased and the children of my granddaughter Rachael Thompson the wife of Ichabod Thompson deceased and the child of my granddaughter, Eunice Brown the wife of Joseph Brown deceased to their heirs and assignees 6 shillings lawful money unto each of them respectively, as they come of lawful age and to be paid by my son Moses after my demise.

Item to my beloved sons, Nathaniel Thayer, Moses Thayer, and Samuel Thayer I give after my decease all common rights in township of Mendon to be equally divided between them.

Also my will is that all and singular the remaining part of my estate of what sort of denomination which I have not already given away or disposed of l give to 6 sons and 4 daughters hereafter mentioned; viz - lsaac Thayer, Ebenezer Thayer, John Thayer, Nathaniel P. Thayer, Joseph Thayer, and Ichabod Thayer, Comfort Keith, Mary Keith, Jerusha Carrary and Patience Chiles and to their heirs and assignees forever an equal proportions between them.

Furthermore, I do hereby will and order that my son Moses Thayer, aforesaid do pay unto my 7 sons Isaac, Ebenezer, John, Nathaniel, Samuel, Joseph and Ichabod and also my 4 daughters, Comfort, Mary, Jerusha and Patience the full and just sum of 15 pounds lawful money to their heirs and assignees in the space of three years after my decease in equal property between them both sons and daughters. Finally I do make and order my beloved Samuyel Thayer, and Uriah Thayer to be the Executors for my last will and testament.
