Know all men by these presens:
That I Stephen E. Montgomery, of the county of Williamson, State of Texas, being in good health, and of sound disposing mind and memory, do make and publish this my last will and testament, hereby revoking all wills by me at anytime made heretofore.
First..... I direct that my body be buried, and my last resting place be marked in a manner befitting my circumstances.
Second..... I direct that all my just debts shall be first paid and that the legacies hereinafter given shall, after the payment of my debts, be paid out ofmy estate.
Third.... I give and bequeath to each of my following children to-wit: Marie Blackman, wife of William Blackman, Alice Hale wife of A.J. Hale and John Montgomery, One ($1.00) Dollar each, to be paid to them by my executor after my death. All of said children having received their part.
Fourth.... I give, bequeath, and demise to my beloved wife, Joanna Montgomery my interest in and to a certain tract of land , lying and being situated in Williamson Co., Texas, known as the Stephen Montgomery Headright, said interest after havien given my children their mothers (my first wife) part, consisting in seventy three and one third (73 1/3) acres of land out of said headright, together with all and singular the rights, members, and appurtenances to the same in ant manner belonging, free from all charges or limitations whatever, in fee simple, to dispose of as she may wish. I also give and bequeath to my beloved wife, in the same unreserved manner, all my household and kitchen furniture, farming tools, horses, buggy, wagon and all other personal property, that may be on hand at the time of my demise, as my wife has invested her seperate estate, consisting of rents and other personal interests in our homestead and personal effects
Fifth... I hereby constitute and appoint my beloved wife, Joanna Montgomery, sole executrix of this, my last will and testament, without bond for her due and legal performance of the same.
Sixth... It is my will that no other action shall be had in the county court in the administration of my estate except to prove and record this will, and to return and inventory and appraisment of my estate and list of claims.
In witness whereof I have hereto set my hand this the 31st day of march A.D. 1908 in the presence of C.J. Hafner and Fred I Fisher who attest the same at my request.

In the County Court of Williamson County Texas, July Term, 1920
To The Hon. F.D. Love, Judge of said Court
1. Now comes Joanna Montgomery and respectfully shows to the court that she resides in the County of Williamson and State of Texas; that S.E. Montgomery is dead and that he died on or about April 10, 1920 at his home near Granger in Williamson County, Texas, and at the time of his death the said S.E. Montgomery was a resident of Williamson County Texas.
2. That at the time of his death the said S.E. Montgomery was seized and possessed of personal property of the probable value of $150.00, all situated in Williamson County, Texas; that the said S.E. Montgomery, deceased left a written will, duly executed, which is hereto attached and made a part hereof, and in which said will your petitioner was named and appointed executrix without bond.
3. That your petitioner is not disqualified by law from accepting letters testamentary.
Wherefore your petitioner prays the court that citation issue herein to all persons interested in said estate as required by law, that said will be admitted to probate, and that letters testamentary be issued to your petitioner, and that such other and further orders be made and entered as to the court may seem proper.
