Whereas about the year 1855, Clinton Herrin, Died intestate in Putnam County, Tennessee, the owner in fee of the following tract or parcel of land being & lying in the 8th Civil District of Putnam County, on Mine Lick Creek and bounds as follows: beginning on a black hickory and black gum, known as the corner of Clinton Herrin's tract of land running east with said line, 80 poles to a stake at the corner of the Ditty's land, thence south, 27 deg. , west with Ditty's line 81 poles to the Gabril Herin line, in all 85 poles to the corner of a 15 acre tract at a sugar tree standing on the bank of Mine Lick Creek, about 10 poles north of Peter(e) Cave, thence east 15 poles to a sugar tree at the foolt of the mountain, thence north, 40 deg. with the Mountain, 68 poles to a lynn, thence north 18 deg. east with said Mountain, 25 poles to a stake in the line of the first tract, thence east with the Ditty & Clinton Herrin line, 36 poles to a hickory and sugar tree on the side of the Mountain, Cinton Herrin's corner, & corner of Amos T. Mott's entry, thence north with said line passing Wiseman Herrin's corner and with his line in all, 122 poles to a stake at the bank of the creek, thence west with the creek 6 poles to a stake in the creek and a sugar tree on the north bank of the creek for a pointer, thence north with Wiseman Herrin's line, 140 poles to a hickory & chestnut oak, thence south 126 poles to the beginning, making in all 126 acres and 112 poles, including the dower ( of 32 acres ) & 12 acres below. And whereas, a bill was filed in the Chancery Court of Putnam County about the years 1855 or 1856 and said land was sold for the partition of proceeds of among those entitled and whereas a dower of thirty - two acres was carved out of the above boundary on the eastern end of the same, as a dower to Sarah Herrin as the widow of Clinton Herrin, Decd. and whereas on the 23rd day of May 1857, Gabril Herrin sold & conveyed unto Amos T. Mott, by deed of general warranty, a certain boundery of land adjoining the above described boundery

And whereas a dispute has arresin as to whether or not the 32 actes set out or carved out of the above boundary as a dower to Sarah Herrin, Widow of Clinton Herrin ( Who after said Clinton Herrin's death, intermarried to one Lewis Maynor ) was sold with the other part of said Clinton Herrin's lands at said Chancery sale and in order to settle and compromise said dispute, I, Lucy J. Barnes, who is one of four children of said Clinton Herrin and who married to my present husband, J.B. Barnes, before I reached the age of 21 years, for the consideration of $170.00 cash, to me in hand paid, the receipt whereof is hereby acknowledged. I, Lucy J. Barnes and my husband, the undersigned J.B. Barnes, do hereby sell, transfer and convey unto Samuel Herrin, his heirs and assigns forever, all the rights, title & interest we have or ever had in and to the above boundary of land or any part of the same, hereby conveying all out claims in or about said land of every kind and description, whether for the title to name, damages for back rents, for timber used or anything else. This conveyance being made to forever settle our claim on or against said boundary of land or any part thereof as an heir of Clinton Herrin, Decd. We state that said Lucy J. Barnes is the daughter of and heir at law, of Clinton Herrin, Deceased, and as such, hereby warrents and convenants to defend the title to said land to the said Samuel Herrin, his heirs & assigns forever against the lawful claims of all persons, whomsoever, this March 2, 1909

Barnes, the barginor with whom I am personall acquainted and who acknowledged that the execution of the said deed instrument to have been done by her freely, voluntarily and understandingly, without compulsion or constraint from her said husband and for the purposes therein expressed.
