The Murder of David Chain (September 17, 1998) and other anti-enviro Humboldt County Hate Crimes
-
"SET POOR LOGGER FREE!" announces Humboldt County District Attorney Terry Farmer. Collusive D.A. announces that Humboldt County will NOT file charges against logger A.E. Ammons, the man who killed David Chain. Farmer will not file charges against witnessing Earth First!ers either. Earth First! Media Center calls for the immediate resignation of Humboldt County District Attorney Terry Farmer for malicious and dangerous incompetence. (December 17, 1998)
-
OUTRAGEOUS, HIDEOUS HUMBOLDT SHERIFF'S DEPT. RECOMMENDATION: "CHARGE ACTIVISTS WITH MANSLAUGHTER!" The Humboldt County Sheriff's official recommendation had been to charge the Earth First! activists who witnessed David Chain's death with the involuntary manslaughter of David Chain! They recommended that no charges be brought against the Killer Logger A.E. Ammons. David Chain's mother Cindy Allsbrooks describes here her meeting with Detective Juan Freeman. (October 22, 1998)

Susan Moloney, Headwaters Forest organizer and support guide for Julia Butterfly's ground crew, became a victim of unrestrained anti-enviro hate crimes, overtly-supported by Humboldt County officials, when a crazed mob demolished her car with their clubs and crowbars in two separate smashing frenzies. The enraged mob then, with a truck, pushed her car over an embankment, crushing its roof; all as she sat defenseless, watching the headlight-illuminated scene, from up in a 160-foot tall tree with another anti-Maxxam treesitter and his sister who had travelled to California to be with him up in the tree for the Christmas holiday. The sitter himself, local land owner Nate Madsen, has been sitting alone in the tree for three months. The violence-ridden Humboldt County sheriffs want this case to be considered a mere incidence of vandalism and are investigating it as such. But this is a HATE CRIME and should be investigated bt the state and federal governments as part of a Hate Crimes investigation of Humboldt County. Please call Humboldt County D.A. Terry Farmer and the California and U.S. Attorney Generals offices and demand such an investigation NOW, before someone else is murdered! Check our address book for contact info. (December 27, 1998)

Judi Bari and the Redwood Summer Justice Project's lawsuit against the F.B.I. and the Oakland, California Police Department
- "FBI Stalling in Bari Case Must Stop, Judge Says"
"SAN FRANCISCO -- A federal magistrate said today he will order the FBI to provide further evidence to lawyers for the late Judi Bari and
fellow Earth First! activist Darryl Cherney. The FBI had claimed that an appeal by codefendant Oakland Police Department of an earlier
ruling in the 7-1/2 yr. lawsuit shielded it from the requirement to provide additional evidence. Using a delaying tactic seen several times before in this case, the Oakland city attorney last winter filed an appeal of an October, 1997, district court decision denying the Oakland police officers "qualified immunity" from suit. The appeal, now pending before the 9th Circuit Court, has already delayed for over a year the setting of a trial date, and the FBI's refusal to cooperate has compounded the effects of that delay." Corporate Government Attempts to Destroy Headwaters Forest and the Greater Coastal Redwood Ecosystem
-
The State of California conspires with MAXXAM/Pacific Lumber Co. to evade state and federal forest-protection laws. The California Department of Fish and Game refuses to charge Pacific Lumber when it violates the law. (December 8, 1998)
-
MAXXAM-criminalized Pacific Lumber Co. was so relentless and operating on such a massive scale of criminality that the state pulled PALCO's 1998 timber operator's permit after hundreds of violations every year since Maxxam took over Pacific Lumber in 1985. EPIC President Paul Mason explains the decision by the California Department of Forestry to make this unprecedented move. (November 10, 1998)
-
So MAXXAM/PALCO then laid-off its crew of 180 company loggers, the men who handle half of the company's logging operations. The company will now continue its onslaught of Liquidation Logging by merely hiring more non-union contract-logging operators who have their own, independant, timber operator's permits. When Julia Butterfly's mom wrote to Andy Caffrey asking if PALCO's license revocation would kill the Headwaters "Deal," this is what he came up with off the top of his head, with a couple of revisions and additions. We welcome any corrections or omissions on our part. Thanks. (November 10, 1998)
-
Concurrently, since September 30, MAXXAM is battling over 3,100 striking members of the United Steel Workers of America union at all five U.S. Kaiser Aluminum factories, owned by Charles Hurwitz's investment group, MAXXAM of Houston, Texas. Hurwitz is trying to break the union by hiring more nonunion replacements for currently unionized positions. Even though the Kaiser workers accepted pay and benefit cuts for years to support the company, Hurwitz now encourages the laid-off Pacific Lumber loggers with opportunities to become scab workers at these union-struck Kaiser factories. (September 30-present)
-
The Earth First! Media Center began organizing with the striking USAW locals to support the strikers and turn up the heat on MAXXAM! One pioneer Earth First! activist went undercover for weeks to get information for the USAW, working as an informant-scab for the stiking workers. With incredible organizing from Olympia Earth First! and Olympia International Workers of the World (I.W.W.), the Earth First! Media Center organized the first ever Earth First!-Union/worker direct action in the United States, with a Puget Sound flotilla blockade of MAXXAM/Kaiser's aluminum ore ship from Australia. (December 7, 1998)
-
This EF! Media Center action was also unique because it was largely organized over the Internet by people in different states who've never seen each other. Here is the original organizing press release. There is still much you can do! This campaign is not over! It's only just begun! (November 18, 1998-present)
Please support the striking U.S.W.A. Kaiser Aluminum workers! Check out the United Steel Workers of America web site for the latest on how you can support this crucial, break-through union strike.

Now that California has its first Democratic governor since before MAXXAM's 1985 hostile-takeover of Pacific Lumber Co., will Gray Davis reverse the state's policy of supporting criminal logging practices? I don't know. Why don't you ask his first political appointee, the head of his transition team, MAXXAM's very-own Barry Munitz?! (November 9, 1998)
We can really use your Help
right now!
The notorious Habitat Conservation Plan (HCP), the Headwaters Deal, and the conspiracy to subvert the Endangered Species Act and ALL of our federal wilderness and wildlife protection laws
-
Former California Governor Pete Wilson and other state offficials, California's Senator Dianne Feinstein and the Clinton Administration have been trying to orchestrate a half-billion dollar looting of state and federal coffers in the guise of a deal to "save" Headwaters Forest by joint acquisition of some of the fragmented old growth groves from Hurwitz. What the deal actually does is open up everything not acquired to fifty years of rapacious, illegal, ecologically-insane logging by PALCO. And thrift-looting Charley Hurwitz gets a cool 480 million dollars of our money stuffed into his pockets by the politicians. More than market value for trees Hurwitz couldn't otherwise log at all if the Clinton and Davis administrations were to, as they have sworn to do, actually enforce the Endangered Species Act to the letter of the law. (RIGHT NOW! TODAY! Hurry! Please come HELP!)
-
At the same time, federal officials with the Office of Thrift Supervision are trying to get back $1.6 billion dollars that Hurwitz and Munitz looted with Michael Milken and Ivan Boesky from United Savings Association of Texas which MAXXAM owned. You can read all about this at the Jail Hurwitz web site. (1985-present)
-
The Headwaters Deal is a Trojan Horse which has embedded within its hallowed, scenic corridors a nationally-significant, precedent-setting Habitat Conservation Plan. When this plan is finalized, and the deal completed, the HCP will prevent citizens from suing over illegal logging in all of Pacific Lumber's holdings for the next fifty years.
-
And now it has been announced that Pacific Lumber doesn't own the mineral rights underneath the Headwaters groves that the government plans to buy from Hurwitz! (December 30, 1998)
-
"The U.S. Department of the Interior has submitted its final habitat plan offer to Pacific Lumber Co. on a take-it-or-leave-it basis," reports the Eureka Times-Standard (December 31, 1998)

KRIS Coho --The Klamath Resource Information System (KRIS) is a computer program that allows easy access to data tables,
charts, photographs and bibliographic materials related to a watershed or specific location. KRIS Coho was compiled to supply information to
the public and management agencies to help them evaluate the Pacific Lumber Company (PALCO) Habitat Conservation
Plan (HCP). It consists of all the available fisheries and water quality data in the public domain, and an electronic map
system.
The PALCO HCP was produced by the company as part of the Headwaters Forest deal and to meet the requirements of
the U.S. Endangered Species Act (ESA). Residing on PALCO lands are the coho salmon, marbled murrelet and spotted
owl, all currently listed as threatened under the ESA. If adopted, the HCP will shape the management of the company's
forests for the next 50 years. Despite the importance of this document, the public and most agency personnel evaluating the plan have not had access to raw data relating to habitat conditions and trends. This precludes independent assessment of the conclusions in the
HCP. KRIS will enable everyone to evaluate the HCP based on the best available science. These web pages are designed to explain the significance of each topic in KRIS Coho and evaluate the PALCO HCP.

After One Year (!), Earth First!er Julia Butterfly Hill is still protesting 180-feet up in a Pacific Lumber Co.-owned, ancient redwood tree. She did not touch the ground once in the entire calendar year of 1998! (December 10, 1998)
-
The incomparable Jim Page, activist singer-songwriter from Seattle has written a new song to commemorate the spirit of Julia's year in Luna. It's titled "Butterfly Wings" and we've posted the lyrics for you to read. (December 10, 1998)
-
"Stafford, CA - On the evening of the Winter Solstice,
Monday, December 21, tree-sitter Julia Butterfly Hill plans
to illuminate the ancient redwood tree Luna, which she has
occupied for over one year in an effort to save it from the
chainsaws of the Pacific Lumber Company/Maxxam. Supporters
of the tree-sit have donated dozens of flashing beacons,
each with a range of over two miles, which will make the
lights clearly visible from State Highway 101 in the
Stafford area. This effort will make Luna the largest,
oldest, living Christmas tree in the world." (December 21, 1998)
-
And there are scattered throughout the county six other tree sitters protesting up in trees on Pacific Lumber land, as well as an encampment at the site of David "Gypsy" Chain's killing. The camp, up on now-renamed Gypsy Mountain, has declared the Gypsy Free Zone. (December 9, 1998)
