Asa Morey’s Will

I got this from looking on Sampubco's web-site. They sent me a copy of a couple of handwritten pages. I have tried to transcribe this exactly as it was written in 1808.

 

The people of the State of New York by the grace of God free and independent to all whom these presents shall come or may concern fond greetings.

Know Ye that at the town of Oxford in the County of Chenango on the twenty second day of January one thousand and eight hundred and eight before John L. Mersereau Esq. Surrogate of our said County the last Will and Testament of Asa Morey deceased (a copy o, whereof is hereunto annexed) was proved and is now approved and allowed of by us and the said cecesed having whilst he lived and at the time of his death good chattels or credits within this State, by means whereof the proving and registering the said will and the granting administration of all and singular the said goods chattels and credits and also the auditing allowing and final discharging the account thereof doth belong unto us. The Administration of all and singular the goods chattels and credits of the said deceased and anyway concerning his will is granted unto Amos Breed Executor in the said will named he being first duly sworn will and faithfully to administer the same and to make and exhibit a true and perfect inventory of all and singular the said good chattels and credits, and also to render a just account thereof when thereunto required. In Testimony whereof we have caused the seal of office of our said Surrogate to be hereunto affixed Witness John L Mersereau Esq. Surrogate of the said County at the town of Oxford aforesaid the twenty second day of Januaary in the year of our lore one thousand eight hundred and eight and of our independence the thirty second.

Know all men by these presents that I Asa Mory of the town of German County of Chenango State of New York calling to mind the mortallity of my body and that it is appointed for all men once to die, I therefore make this for my last will and testament as first and principal I recommend my soul to God that gave it and my body to the dust to be buryed in decent Christian burial. As touching that part of wordly estate that it has pleased God to bless me with. Firstly I give my Son Jesse fifty acres of land on the west part of the lot I live on being Lot ___? Seven in Broekle (or Brockle?) township by running a north and south line parralel with the west line so as to contain fifty acres. I give my loving wife Elizabeth Mory the one third of the remainder of said lot and one third of my moveable estate after her decease to go to my Son Amos. I give the remain of said Lot to my Son Amos and the two thirds of my movable estate and all debts due to me he paying all my just debts and funeral charges. I give to the heirs of my Son John five shillings which is their part of my estate. I give to the heirs of my son Isaac deseast five shillings which is there full full part of my estate. I give my daughter Sarah five shillings which is her full part of my estate. I give my son Asa five shillings which is his full part of my estate. Farther more I appoint my faithful fried Amos Breed the sole executor In testimony hereto I set my hand and seal this nineteenth day of September in the year of our lord one thousand eight hundred and seven Asa Mory (LS) In presents of Jonathan Kinyon (Hinyon?), Benjamin Lanpher, Amos Breed.

Be it remembered that on the twenty second day of January one thousand eight hundred and eigh personally appeared before me John L Mersereau Surrogate of the said County Jonathan Kinyon Benjamin Lanpher & Amos Breed who being subscribing witnesses to the annexed instrument of writing who being severally sworn depose and say that they did see Asa Morey deceased sign and seal the annexed containd instrument of writing purporting to be his last will and testament and heard him pronounce publish and declare the same as and for his last will & testament & that at the time of the execution thereof he the said Asa Mory was of sound mind memory and understanding to the best of the knowledge and belief of them. The said deponents and that we together signed our respective names as witnesses thereto except as to Benjamin Lanpher who requested the said Amos Bred to sign his name for him which was done in our presence at the request and in the presence of the said Testator and also in in the presence of each other.
