This is the most disgusting part of Goliath. My wife Barbara was severely injured when a rack of lumber fell on her in a Home Depot Store. She has not had a pain free day since her accident. She suffers from muscle spasms 24 hours a day seven days a week. Headaches that at times totally incapacitates her. Her whole body is subject to horrendous cramping and when her chest cramps she has difficulty breathing. The physical therapist that has recently treated her says that she can only sustain any activity for no more than 20 minutes. Her story will follow, but for now I want to explain how Home Depot keeps on continually victimizing her.
When she was first injured we were assured that Goliath (Home Depot) would pay all her medical expenses. Linda Holloway at GAB said she would issue a claim number and take care of all medical expenses. Please Click Here To See Document.
After Barbara was hurt I talked with Ken Hall Lumber buyer for Home Depot. He advised me that they reconstructed the accident in their Tampa warehouse and that changes made to the lumber racks were responsible for the injuries to Barbara. That by not having a kicker and back boards on the racks and the change from a 2X6 floor to 3/4 plywood caused the accident and that they were going to change the racks back to the safe way they were . I asked him if Goliath (Home Depot) was going to take care of all Barbara's medical expenses. He put me on hold and checked with his boss Ron Jarvis who in turn checked with his boss Tony Brown and he confirmed that they would take care of all medical expenses. He then gave me the number to Home Depot GAB Insurance and said they would make payment. I spoke to Linda Holloway and explained that I was told to call. She said that Home Depot would not pay the expenses until they determined that they were at fault. That we should pay and if they determined they were liable they would reimburse us. I told her that Home Depot had already determined they were at fault and to please call Ken Hall in Tampa. She put me on hold and called Tampa. After confirmation she asked to talk with Barbara and recorded a statement as to the accident. When finished with the statement she explained to me that since Barbara was not an employee of The Home Depot that she could not be covered under their Health care policy, that instead she would issue a letter for all medical treatment on their General Liability Policy. She said that it would have our claim number and a phone number that the care provider could call and get payment information. But they were lying to us instead we received a letter declining our claim. Please Click Here To view Document. She was brutally victimized again by Goliath. Instead of taking care of their responsibilty they left her in total need of medical care and terrible pain with no insurance. See Why No Insurance. Home Depot Put Us Out Of Business. But the worst victimazation came from Home Depot´s Insurance Co. Attorney Daniel R. Murphy, Esquire. |
